Position

Sangita is a director of immigration at Duncan Lewis Solicitors, supervising a team of solicitors, trainees and caseworkers, at the Harrow, Leicester and Birmingham offices, all dedicated to representing the most vulnerable in society. Sangita has over 18 years of experience in Immigration and Asylum Law, and covers all aspects of immigration, nationality, asylum, and human rights law with emphasis on asylum seekers, other vulnerable immigrants, deportation cases, minors, victims of torture and trafficking. Her work is concentrated on publicly funded clients, with a particular focus advising on immigration law, practice and policy as well as coordinating and managing the delivery of services to clients across multiple jurisdictions.

Sangita has an enhanced CRB status which permits her to represent unaccompanied asylum-seeking children. Sangita has extensive experience in dealing with judicial review matters, detained asylum cases, bail applications, entry clearance applications, injunctive relief against removal and conducting appeals against adverse decisions to the First Tier/Upper Tribunal of the Immigration Asylum Chamber and various other challenges to the policies of the Secretary of State.

She has considerable experience conducting advocacy before the Immigration Tribunals and is a member of both the Law Society and the Refugee Council.

She was lead partner (with Toufique Hossain) on the case SQ (Pakistan) & Anor R (on the application of) v The Upper Tribunal Immigration and Asylum Chamber & Anor [2013] EWCA Civ 1251 (22 October 2013). This was a landmark Court of Appeal case involving the rights of foreign national children to access UK medical treatment.

Career

Sangita qualified as a solicitor in 2002. She joined Duncan Lewis as a supervisor in 2007 and was appointed a partner-level director in 2011.

Duncan Lewis Solicitors’s immigration and asylum practice specialises in contentious matters. It represents vulnerable clients such as trafficking or torture victims in detention-related matters, handles judicial review applications and proceedings, and assists individuals with appeals and higher court cases. The team also acts for unaccompanied asylum seeking children in asylum fast-track cases. Sangita Shah represented an individual in a First Tier Tribunal asylum appeal involving issues of misleading the Home Office, and assisted a family member of an EEA national with the application for permanent residence, complicated by previous non-disclosure of an unspent conviction. The firm also acted for a victim of torture from Cameroon in judicial review proceedings challenging unlawful detention, and managed an asylum application for an inter-faith married couple. Kaajal Chandrasingh joined the Royal College of Nursing as an immigration solicitor.
