Position

Public law solicitor Stefan Vnuk acts in all areas of immigration, asylum, and human rights law, specialising in complex cases in the higher courts, including the Supreme Court and the European Court of Human Rights.

Stefan’s lead reported cases in the Supreme Court include; Robinson [2019] UKSC 11, relating to the interpretation of rights of appeal and fresh claims; Nouazli [2016] UKSC 16, relating to the UK’s power to detain EU nationals and discrimination; and O [2016] UKSC 19, relating to detention of mentally ill persons and Home Office policy.

His successful cases in the ECHR include VM v UK (Application no. 49734/12), SMM v UK (Application no. 77450/12) and VM v UK (No 2) (Application no. 62824/16).

His recent reported Upper Tribunal case DH (Particular Social Group: Mental Health) Afghanistan [2020] UKUT 223 (IAC), affirmed the supremacy of the Refugee Convention 1951 over EU law by reference to the Convention’s object and purpose.

Career

Stefan joined Duncan Lewis Solicitors in autumn 2018, prior to this he spent seven years as head of the public law department at LUPINS.

Memberships

Stefan has been a member of the Immigration Law Practitioners’ Association (ILPA) since 1997 and is an Advanced Caseworker (Level 3) under the Law Society’s Immigration and Asylum Accreditation Scheme. There are only a small number of immigration practitioners throughout England & Wales that hold this quality mark.

Education

Stefan obtained his GDL from the University of South Australia and prior to this received a Bachelor of Laws (Hons) from the University of Adelaide.
