Position

There are three main aspects to Benjamin De Sevin’s practice.

First of all, public contract law (public procurement, concessions, occupation of the public domain, etc.). He assists French and international public entities and private operators in the conclusion and performance of their contracts, both as counsel and in litigation, with particular expertise in infrastructure concessions and PPPs (public-private partnerships). he is often involved in dealing with difficulties in the performance of public contracts, both in litigation and in the context of alternative dispute resolution.

Secondly, the regulation of economic activities. Benjamin assists clients in highly regulated sectors (transport, gaming, energy, data, health, etc.) or in matters where public authorities are involved (State aid, public company law, foreign investment control, etc.). In particular, he represents numerous private operators before domestic and European courts and authorities, in the context of contentious challenges to decisions or rules, or their consequences in terms of compensation. He also assists these operators in the context of their public affairs strategy.

Thirdly, compliance and criminal law. Benjamin advises numerous clients on public criminal law and ethics, both in the context of litigation before the criminal courts, in conjunction with the firm’s criminal lawyers, and in the implementation of prudential measures – in particular the obligations arising from the Sapin II law.

UGGC Avocats‘ public law practice benefits from a sizable and experienced team. The firm advises both leading private operators and public sector entities. Corinne Khayat at UGGC Avocats recently served as co-counsel to Veolia, along with other firms, on its notification to the Moroccan Competition Council regarding its high-profile acquisition of Suez, showcasing the firm’s expertise in Moroccan competition law. Khayat and Michel Ponsard oversee much of the firm’s work, with Khayat taking on appeals against sanctions by the FCA, and Ponsard covering merger control, litigation and distribution, including handling FCA clearance. Malka Marcinkowski focuses on the healthcare sector, working on antitrust investigations, competition issues in marketing and distribution, while Benjamin De Sevin has experience in contesting measures to transpose the 2019 Single-Use Plastics Directive.

La pratique de droit public d’ UGGC Avocats est servie par un large effectif très expérimenté. Le cabinet conseille des opérateurs privés de premier plan ainsi que des entités publiques. Corinne Khayat , chez UGGC Avocats, a conseillé Veolia sur la notification de son acquisition de Suez au Maroc (exemple illustrant l’expertise du cabinet en droit marocain de la concurrence) et gère aussi des procédures en appel de sanctions de l’Autorité de la Concurrence. Elle est l’une des principales membres actives au sein de la pratique, avec Michel Ponsard qui traite des dossiers de concentration, de contentieux antitrust et de distribution, en intervenant si besoin devant l’Autorité de la Concurrence. Malka Marcinkowski est une experte du secteur de la santé, qui est amenée à traiter des enquêtes antitrust et des sujets de droit de la concurrence liés à des projets de marketing et de distribution. Enfin, Benjamin De Sevin  dispose d’une solide expertise dans la gestion des problématiques de transposition de la directive 2019 sur les plastiques à usage unique.
