Career

Borja Sainz de Aja joined Uría Menéndez in 1999 and headed its office in Lima from November 2002 until September 2004. He specialises in Intellectual Property, distribution, unfair competition, advertising, data protection law and litigation relating to these areas of law.

He regularly advises engineering and technology multinationals and other companies in sectors such as electronics, microelectronics, software, food, beverages, tobacco, textiles and education on the negotiation, drafting and structure of contracts and transactions. Borja also represents these clients before regulatory bodies and courts in proceedings on the protection of patents, trademarks, industrial designs, copyright, know-how and other intellectual property rights.

Moreover, Borja advises market leaders in the telecommunications, electronics, financial services and food and drinks sectors in litigation and non-litigation matters regarding unfair competition and advertising issues, including passing-off, gaining unfair advantage from the reputation of others, misleading practices, sales below cost, protection of trade secrets, misappropriation of trademarks and getting ups.

His expertise includes advising on commercial law issues, including corporate matters and collaboration contracts. He specialises in drafting distribution, software and internet related contracts. Borja has been involved in the drafting of the corporate aspects and standard conditions of leading Spanish on-line service providers.

Borja has extensive experience on personal data protection and advises multinational and domestic clients from all sectors on the design, regularisation and processing of their databases and information systems.
