Simon also known as Chico was called to the Bar in 1990. 

Chico heads up the firms personal injury practice. His experience in personal injuries is extensive and he is primarily instructed by Insurers and organisations such as the MIB in the defence of claims. He is able to advise on all matters of personal injury litigation arising from road traffic accidents, accidents at work involving alleged breaches of health and safety legislation, employer’s liability cases alleging stress at work, and other cases involving alleged psychiatric injury. Chico has experience in complex high value brain injury cases and has acted in cases involving highly technical evidence in relation to the applicable discount rate in Gibraltar for the assessment of future damages. 

Chico’s experience extends to clinical negligence where in addition to defending claims against practitioners and clinics he has acted claimants in cases with complex issues of causation.

Aside from personal injury, Chico is capable of advising in all matters of civil litigation and has recently advised on high value construction disputes both for the developer as well as the construction company with effective results.

Chico has appeared in the Courts in Gibraltar at every level including the coroner’s court and the Judicial Committee of the Privy Council where appeared as junior counsel successfully defending an appeal from the Gibraltar Court of Appeal for the Government of Gibraltar. [Almeda v HM Attorney General for Gibraltar (2003 UKPC 81)].

Recently, he has successfully led in negotiating out-of-court settlements of high-value personal injury claims on behalf of defendants. At two recent joint settlement meetings he advised on and brought about the satisfactory resolution of claims valued at £2.5 million and £750,000. He has also acted in various mediations and most recently he successfully concluded the settlement of a personal injury claim valued at £1.6 million involving a protected party which required the Court’s approval.

In addition, Chico has considerable experience in probate work. He has recently represented a client in a contentious international matter requiring advice on the validity of a will of a British testator domiciled in Spain leaving assets in Spain and Gibraltar.

Chico is also the head of the firm’s intellectual property and trademark practice as well as being a member of the firm’s shipping and admiralty where he has considerable experience in ship registration as well acting for Banks in relation to the financing of Gibraltar registered ships.
