Dr. Magnus Hirsch advises both German and international clients on a wide variety of matters which fall within the area of trademarks, designs, copyrights, patents and unfair competition – in both preventative and contentious situations.

He also has more than twenty years of intellectual property litigation experience, having worked on numerous litigation matters regarding all kinds of IP issues and has appeared in many Federal District Courts, as well as Courts of Appeal, throughout Germany, and has represented several clients in proceedings up to the Federal Court of Justice.

In particular, his specialization comprises portfolio management as well as enforcing clients’ rights against counterfeiters, parallel importers and domain name pirates, both through court proceedings, as well as international dispute systems. Mr. Hirsch also represents clients before the German Patent and Trademark Office and the European Union Intellectual Property Office (EUIPO) registering or opposing German national trademarks and Community Trade Marks, respectively. He also has significant experience in drafting IP-related agreements, such as trademark license agreements, priority agreements and agreements with publicity agencies.

Dr. Magnus Hirsch spent several months practicing at the Hong Kong office of an international law firm where he focused on Asian IP law, especially the enforcement of intellectual property rights in and out of court and the prosecution of product piracy and trademark counterfeiting in South-East Asia.

SKW Schwarz Rechtsanwälte betreut im Markenrecht im Einklang mit der Ausrichtung der Kanzlei auf IT und digitale Wirtschaft, Medien und Technologie. Besondere Beratungsschwerpunkte bilden der Bereich E-Sport, Branded Content, zu dem auch Influencer Marketing gehört, sowie medizinisches Cannabis und die wachsende Tätigkeit im Bereich FMCG, beispielsweise für Lebensmittel- und Kosmetikunternehmen. Das Beratungsspektrum erfasst dabei neben der strategischen Portfolioberatung und Lizenzverträgen, insbesondere in Vertriebskontexten, auch eine zunehmend etablierte Prozesspraxis. Letztere wurde vor allem mit grenzüberschreitenden Mandaten ausgebaut, für die man unter anderem auf das TerraLex-Netzwerk zurückgreift. Die Nutzung von LegalTech wurde durch die eigens gegründete SKW@Tech GmbH klar als integraler Bestandteil des Beratungsangebots aufgestellt. Zum Team von Praxisgruppenleiter Sascha Pres in Berlin gehören auch die umfassend im Gewerblichen Rechtsschutz tätigen Margret Knitter und Dorothee Altenburg in München, die Berliner Sandra Sophia Redeker, Markus Brock und Markus von Fuchs sowie Magnus Hirsch im Frankfurter Büro. Ulrich Hildebrandt wechselte im Januar 2021 zu Hildebrandt.

SKW Schwarz Rechtsanwälte‘s advice on trade mark law mirrors the firm’s industry focus on the IT, digital economy, media and technology sectors. Among the key topics are e-sports, branded content, including influencer marketing, as well as medicinal cannabis and the growth area FMCG, especially pertaining to the food and cosmetics industries. The service offering also includes strategic portfolio advice and licensing agreements, including distribution matters, and the increasingly busy litigation practice. The latter primarily expanded with cross-border mandates, with additional expertise from the TerraLex network, among others. The importance of legal tech was emphasised with the founding of the SKW@Tech GmbH. Led by practice head Sascha Pres in Berlin, the group also includes Margret Knitter and Dorothee Altenburg in Munich, who have longstanding expertise in IP, Berlin-based Sandra Sophia Redeker , Markus Brock as well as  Markus von Fuchs and Magnus Hirsch in Frankfurt.
