Maiken Toftgaard specialises in IP and the cross fields between consumer law and marketing law, e-commerce, e-privacy and personal data. Maiken has wide experience in the drafting and execution of IP strategies, the regulation of digital platforms and the use of data from her work as an attorney and her previous employment as an in-house lawyer in a media group.


Maiken advises on all parts of IP and digital business. She is especially experienced in ensuring compliance with the regulation on marketing activities on websites and social media as well as compliance with the rules on spam and surreptitious advertising. Maiken also advises on compliance with the law on consumer agreements and personal data in connection with e-commerce and on digital platforms in general. In addition, Maiken assists with the preparation and execution of IP strategies where she is particularly experienced in securing trademark rights and trade secrets.She also has wide experience in the preparation, negotiation and interpretation of contracts on IP rights and the handling of disputes about infringement of rights. Maiken also advises on the procurement of software and digital services where she primarily advises on securing or assigning rights and on concluding licence agreements. In addition, Maiken is experienced in ensuring that businesses comply with personal data obligations in connection with digital processing of personal data. She advises on personal data law matters, including in relation to the conclusion of data processing agreements, the use of cookies, preparation of consent forms and the use of personal data for marketing purposes. Maiken is an experienced lecturer who regularly gives presentations within IP and digital business.
