Position

Monique de Witte-van den Haak is a very experienced lawyer. She has specialised in employment relationships, focusing on issues of co-determination, employer’s liability, equal treatment, individual and collective legal status, and mediation. She focuses mainly on employment in the public sector. She is very experienced in, and well known for her high level practice in Dutch governmental employment issues. She is involved in dealing with the dismissal of high-ranking officials, particularly when these are politically or administratively sensitive. In her practice Monique has dealt with much-discussed and delicate collective actions and the right to strike. She also gives extensive advice and conducts many legal proceedings in connection with violations of integrity. Monique is intensively involved in the ‘Wet normalisering rechtspositie ambtenaren’. She acted as the lawyer of the Dutch state in a legal procedure (both in first instance and in appeal) concerning the request of the unions not to ratify this law. She is a member of the Standardisation Transition team. Her clients include various ministries, the Dutch Council for the Judiciary, the municipalities of Rotterdam, The Hague and Utrecht, the Ministry of Security and Justice and numerous other governmental bodies. She is also active in the world of scientific education and research. Monique is chair of the Vereniging voor Ambtenaar en Recht, a platform for those whose work involves employment relationships in the public sector. She lectures on a regular basis. In addition, she was recently appointed as coordinator of the public service law cluster of the most important administrative case law journal in the Netherlands, the AB. She publishes regularlyFinally, Monique is also a member of the specialist Dutch Employment Lawyers Association.
