Restructuring and insolvency

Position

I am a partner and head of the Restructuring and Insolvency Department of Fieldfisher JAUSAS since 2003. I am a renowned expert in restructuring and reorganization as well as in national and international insolvency proceedings, from both the bankrupt and creditor’s point of view. My areas of specialization include the acquisition of productive units in the context of insolvency proceedings.

Moreover, as an expert in Mergers and Acquisitions (M&A), I have led numerous purchase and sales transactions and other restructuring operations for both Spanish and foreign clients. Thanks to my ability to negotiate in time-limited situations, I am especially competent in accelerated sales processes and other particular circumstances (distressed M&A).

According to Chambers & Partners, my clients describe me as “very knowledgeable and with a lot of experience with international work”, and consider that I have everything they would look for: “the knowledge, experience, practicality and punctuality.”

Career

Studied in Barcelona; qualified 1982; head of legal advisory and vice-secretary of the board of directors at Compañía de Industrias Agrícolas and Ebro Agrícolas; deputy head of personnel at CASA; partner at Fieldfisher JAUSAS 2003 to date.

I am a member of the Insolvency Institute (III), Insol Europe, the International Bar Association, Insolvency Cooperation Partners (ICP), and the Spanish Private Equity and Venture Capital Association (ASCRI), with which I collaborate on a regular basis on working sessions and initiatives to raise awareness of legislative developments in Commercial and Insolvency Law. 

Past co-chairman Insolvency, Restructuring and Creditor’s Rights Section of the International Bar Association (IBA) and also past member of the Insolvency Law Commission of the Barcelona Bar.

Finally, I also regularly take part in conferences and international meetings as a speaker.

  • Life Sciences Overview 2008/09

    Law 29/2006 (26 July 2006) on guarantees and rational use of medicinal products and medical devices is the central regulation governing medicinal products. The law still requires development through a large number of Royal Decrees, during 2008 and 2009. Many provisions of Law 29/2006 (such as the sale by post or by telematic means of certain medicinal products) do not appear to be enforceable until such legislation is enacted. This particularly applies to rules on medical devices, which are included in Law 29/2006, but need legislation to be effectively enforced. Such specific legislation is currently being developed, including for medical prescriptions and traceability.
