Under the new law,\u00a0<strong>18-year-olds<\/strong>\u00a0will, in many civil matters, be recognised as adults, allowing them to sign agreements,\u00a0<strong>manage<\/strong>\u00a0<a href=\"https:\/\/www.professionallawyer.me\/legal-articles\/business\/what-is-finance-lease\">finances<\/a>, participate in\u00a0<strong>civil proceedings<\/strong>,\u00a0<strong>establish businesses<\/strong>\u00a0and deal with certain assets without requiring parental or guardian approval. However,\u00a0<strong>legal experts<\/strong>\u00a0say the reform extends well beyond the age change, introducing comprehensive updates to rules governing contracts, negotiations, liability, compensation and\u00a0<strong>dispute resolution<\/strong>.<\/p>\n<h2>Wider impact on daily life<\/h2>\n<p>The changes are expected to affect a broad range of\u00a0<strong>everyday transactions<\/strong>, from\u00a0<strong>renting homes<\/strong>\u00a0and signing\u00a0<strong>service agreements<\/strong>\u00a0to resolving failed business deals and pursuing\u00a0<strong>compensation claims<\/strong>.<\/p>\n<p>A central feature of the new legislation is the\u00a0<strong>strengthening of obligations that apply before and after a contract is signed<\/strong>. Courts will also have authority to review pre-agreed\u00a0<strong>contractual penalties<\/strong>\u00a0if they are deemed excessive or fail to reflect actual damages.<\/p>\n<p>For consumers and businesses, this could affect provisions relating to\u00a0<strong>late-payment charges<\/strong>,\u00a0<strong>cancellation fees<\/strong>,\u00a0<strong>delay penalties<\/strong>,\u00a0<strong>service penalties<\/strong>\u00a0and compensation clauses.<\/p>\n<h2>Time limits and record-keeping<\/h2>\n<p>Another notable reform concerns\u00a0<strong>limitation periods<\/strong>\u00a0for civil claims.<\/p>\n<p>The new law provides\u00a0<strong>clearer guidance<\/strong>\u00a0on deadlines for filing cases, making it increasingly important for residents and businesses to identify the type of claim involved and act within the\u00a0<strong>prescribed timeframe<\/strong>.<\/p>\n<p>Legal experts say this places greater emphasis on\u00a0<strong>maintaining proper documentation<\/strong>.\u00a0<strong>Emails<\/strong>,\u00a0<strong>text messages<\/strong>, invoices, contracts,\u00a0<strong>payment records<\/strong>\u00a0and\u00a0<strong>written notices<\/strong>\u00a0may become crucial evidence if disputes later reach the courts.<\/p>\n<h2>Enforcement of judgments<\/h2>\n<p>The legislation also strengthens the framework for enforcing\u00a0<strong>civil judgments<\/strong>.<\/p>\n<p>Once a judgment becomes final, enforcement measures may extend to\u00a0<strong>bank accounts<\/strong>,\u00a0<strong>movable assets<\/strong>, receivables and property, depending on the nature of the case and procedures outlined in the Civil Procedure Law.<\/p>\n<h2>Cross-border and free-zone contracts<\/h2>\n<p>The reform also addresses contracts involving multiple legal jurisdictions.<\/p>\n<p>While the UAE mainland follows a\u00a0<strong>civil law system<\/strong>, separate legal frameworks operate within financial free zones such as the\u00a0<strong>Dubai International Financial Centre (DIFC)<\/strong>\u00a0and the\u00a0<strong>Abu Dhabi Global Market (ADGM)<\/strong>.<\/p>\n<p>Under the new law, parties entering contracts will be encouraged to clearly specify which\u00a0<strong>legal system<\/strong>\u00a0governs their agreement and where disputes will be heard.<\/p>\n<p>This is expected to be particularly important for\u00a0<strong>investors<\/strong>, property owners, businesses and residents involved in\u00a0<strong>cross-border transactions<\/strong>\u00a0or\u00a0<strong>free-zone-related activities<\/strong>.<\/p>\n<h2>Greater awareness of legal obligations<\/h2>\n<p>Legal experts view the reforms as part of a broader effort to modernise\u00a0<strong>civil transactions<\/strong>\u00a0and encourage responsible conduct.<\/p>\n<p>Dr Hasan Elhais, Legal Consultant at\u00a0<strong>Amal Al Rashedi Lawyers and Legal Consultants<\/strong>, said the changes reinforce the principle that contracts are\u00a0<strong>legally binding<\/strong>\u00a0commitments rather than routine paperwork.<\/p>\n<p><em>\u201cThe practical effect of this law is that people will need to be more careful before they\u00a0<strong>sign<\/strong>, not after a\u00a0<strong>problem happens<\/strong>,\u201d<\/em>\u00a0Dr Elhais said.<\/p>\n<p><em>\u201cMany residents sign tenancy agreements, service contracts, loan documents, partnership agreements or\u00a0<strong>property-related<\/strong>\u00a0papers without reading every clause. The\u00a0<strong>new law<\/strong>\u00a0makes clarity, disclosure and responsibility more important, so both sides should know exactly what they are agreeing to.\u201d<\/em><\/p>\n<h2>New responsibilities for young adults<\/h2>\n<p>According to Dr Elhais, lowering the age of adulthood to 18 grants\u00a0<strong>greater independence<\/strong>\u00a0but also introduces\u00a0<strong>greater responsibility<\/strong>.<\/p>\n<p><em>\u201cFor young adults, this is a major step towards\u00a0<strong>independence<\/strong>,\u201d<\/em>\u00a0he said.\u00a0<em>\u201cBut independence also means\u00a0<strong>accountability<\/strong>. If an 18-year-old signs a binding contract, opens a business or takes on a\u00a0<strong>financial obligation<\/strong>, the decision may no longer be treated as something that can easily be reversed because of age.\u201d<\/em><\/p>\n<h2>Good-faith negotiations gain importance<\/h2>\n<p>Dr Elhais said the enhanced good-faith provisions could help\u00a0<strong>prevent disputes<\/strong>\u00a0before contracts are finalised.<\/p>\n<p><em>\u201cIn many cases, the\u00a0<strong>disagreement<\/strong>\u00a0is not only about what is written in the contract but about what was said\u00a0<strong>before signing<\/strong>, what was not disclosed, and whether one party was led to believe something that was\u00a0<strong>not true<\/strong>.
