{"id":56942,"date":"2026-06-03T09:59:07","date_gmt":"2026-06-03T09:59:07","guid":{"rendered":"https:\/\/my.legal500.com\/developments\/?post_type=legal_developments&#038;p=56942"},"modified":"2026-06-03T09:59:07","modified_gmt":"2026-06-03T09:59:07","slug":"dubai-buyer-wins-fresh-hearing-in-dh4-6m-hotel-apartment-dispute","status":"publish","type":"legal_developments","link":"https:\/\/my.legal500.com\/developments\/thought-leadership\/dubai-buyer-wins-fresh-hearing-in-dh4-6m-hotel-apartment-dispute\/","title":{"rendered":"Dubai buyer wins fresh hearing in Dh4.6m hotel apartment dispute"},"content":{"rendered":"<p>Dubai: A Dubai\u00a0<a href=\"https:\/\/www.professionallawyer.me\/legal-articles\/property-law\/off-plan-property-delays-in-the-uae-what-are-the-legal-rights-of-a-buyer\">property<\/a>\u00a0buyer who paid more than Dh4.6 million for what he believed was a\u00a0<strong>hotel apartment<\/strong>\u00a0has secured a\u00a0<strong>fresh hearing before the Court of Appeal<\/strong>\u00a0after discovering the unit handed over to him was\u00a0<strong>classified as residential instead<\/strong>.<\/p>\n<p>In a significant ruling, the\u00a0<strong>Dubai Court of Cassation<\/strong>\u00a0overturned an earlier appeal judgment that had dismissed the buyer\u2019s claim to\u00a0<strong>recover Dh1.55 million<\/strong>, finding that the lower court failed to properly address key\u00a0<strong>contradictions in the evidence<\/strong>\u00a0and objections raised against an\u00a0<strong>expert report<\/strong>.<\/p>\n<p>The dispute centres on a\u00a0<strong>luxury property<\/strong>\u00a0in\u00a0<strong>Dubailand<\/strong>\u00a0that was sold by a\u00a0<a href=\"https:\/\/www.professionallawyer.me\/legal-articles\/criminal-law\/how-to-handle-breach-of-trust-cases-in-dubai-expert-guide-from-a-lawyer-in-uae\">Dubai<\/a>-based developer in October 2013. Court records show the buyer agreed to purchase the unit as a\u00a0<strong>hotel apartment<\/strong>\u00a0for Dh3.13 million and later paid additional\u00a0<strong>service and maintenance charges<\/strong>, bringing the total amount paid to Dh4.69 million. According to the buyer, the project was\u00a0<strong>scheduled for completion in December 2015<\/strong>, but the\u00a0<strong>handover was delayed<\/strong>. When the property was eventually delivered, he claimed he discovered the unit was\u00a0<a href=\"https:\/\/www.professionallawyer.me\/legal-articles\/property-law\/what-are-the-updates-on-tenancy-law-for-family-only-residential-buildings-in-the-uae\">residential<\/a>\u00a0rather than\u00a0<strong>hotel-use<\/strong>\u00a0\u2014 a difference he argued fundamentally altered the\u00a0<strong>nature and value of the investment<\/strong>.<\/p>\n<p>The buyer also alleged\u00a0<strong>construction defects<\/strong>\u00a0and a discrepancy in the unit\u2019s actual area compared to what had been agreed in the contract.<\/p>\n<p>The\u00a0<strong>legal battle<\/strong>, which began in 2021, has passed through several stages before Dubai courts.<\/p>\n<p>In 2022, the Dubai\u00a0<strong>Court of First Instance<\/strong>\u00a0ruled in the buyer\u2019s favour, cancelling the sale agreement and ordering the developer to refund\u00a0<strong>Dh4.69 million with interest<\/strong>. That judgment was initially upheld before later being overturned by the\u00a0<strong>Court of Cassation<\/strong>.<\/p>\n<p>The case then continued over an alternative claim filed by the buyer seeking Dh1.55 million, which he argued had been\u00a0<strong>paid without legal basis<\/strong>.<\/p>\n<p>In May 2025, the\u00a0<strong>Court of First Instance<\/strong>\u00a0accepted that claim, but the Dubai\u00a0<strong>Court of Appeal<\/strong>\u00a0later reversed the decision and dismissed it.<\/p>\n<p>The buyer challenged the appeal ruling, arguing that the court had relied heavily on a\u00a0<strong>supplementary expert report<\/strong>\u00a0prepared using\u00a0<strong>account statements<\/strong>\u00a0submitted by the\u00a0<strong>developer<\/strong>. He said those statements contradicted both an\u00a0<strong>earlier expert report<\/strong>\u00a0and a\u00a0<strong>clearance certificate<\/strong>\u00a0issued by the company confirming\u00a0<strong>receipt of Dh4.69 million<\/strong>.<\/p>\n<p>In its latest ruling, the\u00a0<strong>Court of Cassation<\/strong>\u00a0stressed that while courts are entitled to rely on expert reports, they must address\u00a0<strong>serious objections<\/strong>\u00a0raised by plaintiffs when those objections could\u00a0<strong>influence<\/strong>\u00a0the outcome of the\u00a0<a href=\"https:\/\/www.professionallawyer.me\/publications\/family-law\/dubai-court-revises-visitation-days-in-child-custody-case-due-to-fathers-work-schedule\">case<\/a>.<\/p>\n<p>The court found that the\u00a0<strong>appeal court<\/strong>\u00a0failed to properly examine the buyer\u2019s arguments, particularly the alleged inconsistencies between the\u00a0<strong>original expert findings<\/strong>\u00a0and the supplementary report.<\/p>\n<p>Judges also noted the developer\u2019s defence that the clearance certificate confirming the Dh4.69 million payment had been\u00a0<strong>issued mistakenly by its accounts department<\/strong>.<\/p>\n<p>The Court of Cassation ultimately overturned the appeal judgment and\u00a0<strong>referred the case back to the Court of Appeal<\/strong>\u00a0for reconsideration. It also ordered the developer to pay\u00a0<strong>court costs<\/strong>\u00a0and Dh2,000 in\u00a0<strong>legal fees<\/strong>.<\/p>\n<p><a href=\"https:\/\/www.professionallawyer.me\/legal-articles\/criminal-law\/illegal-drugs-in-dubai-how-to-stay-safe-and-legal-in-the-uae\">Legal<\/a>\u00a0experts say the dispute highlights the importance of precise\u00a0<strong>property classifications<\/strong>\u00a0and clear documentation in Dubai\u2019s\u00a0<strong>real estate market<\/strong>.<\/p>\n<p><strong>Dr Hasan Elhais<\/strong>, legal consultant at Amal Al Rashedi Lawyers and Legal Consultants, said the distinction between a\u00a0<strong>hotel apartment<\/strong>\u00a0and a\u00a0<strong>residential unit<\/strong>\u00a0is far from a minor contractual detail.<\/p>\n<p><em>\u201cThe distinction between a hotel apartment and a\u00a0<strong>residential unit<\/strong>\u00a0is not a minor description. It may affect the\u00a0<strong>buyer\u2019s expected use of the property<\/strong>, its\u00a0<a href=\"https:\/\/www.professionallawyer.me\/legal-articles\/criminal-law\/a-transformation-of-the-gaming-industry-in-the-uae\">commercial<\/a>\u00a0value, the\u00a0<strong>return on investment<\/strong>\u00a0and the obligations attached to it,\u201d<\/em>\u00a0he said.<\/p>\n<p><em>\u201cWhen a\u00a0<strong>purchaser<\/strong>\u00a0enters into a contract on the basis that the unit will have a\u00a0<strong>particular use or classification<\/strong>, any alleged change in that use can become a central issue in determining whether the buyer received what was\u00a0<strong>actually agreed<\/strong>.\u201d<\/em><\/p>\n<p>Dr Elhais added that the ruling also reinforces the\u00a0<strong>importance of maintaining accurate records<\/strong>\u00a0in real estate transactions.<\/p>\n<p><em>\u201cIn\u00a0<strong>real estate disputes<\/strong>, a clearance certificate,\u00a0<strong>payment record<\/strong>\u00a0or expert finding can carry significant weight,\u201d<\/em>\u00a0he said.\u00a0<em>\u201cIf there is a contradiction between\u00a0<strong>documents<\/strong>, the court must be able to see a clear path explaining which\u00a0<strong>evidence<\/strong>\u00a0was accepted, which was rejected and why.\u201d<\/em><\/p>\n","protected":false},"featured_media":0,"template":"","class_list":["post-56942","legal_developments","type-legal_developments","status-publish","hentry"],"acf":[],"_links":{"self":[{"href":"https:\/\/my.legal500.com\/developments\/wp-json\/wp\/v2\/legal_developments\/56942","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/my.legal500.com\/developments\/wp-json\/wp\/v2\/legal_developments"}],"about":[{"href":"https:\/\/my.legal500.com\/developments\/wp-json\/wp\/v2\/types\/legal_developments"}],"wp:attachment":[{"href":"https:\/\/my.legal500.com\/developments\/wp-json\/wp\/v2\/media?parent=56942"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
