{"id":56936,"date":"2026-06-03T09:41:35","date_gmt":"2026-06-03T09:41:35","guid":{"rendered":"https:\/\/my.legal500.com\/developments\/?post_type=legal_developments&#038;p=56936"},"modified":"2026-06-03T09:41:35","modified_gmt":"2026-06-03T09:41:35","slug":"dubai-court-revises-visitation-days-in-child-custody-case-due-to-fathers-work-schedule","status":"publish","type":"legal_developments","link":"https:\/\/my.legal500.com\/developments\/thought-leadership\/dubai-court-revises-visitation-days-in-child-custody-case-due-to-fathers-work-schedule\/","title":{"rendered":"Dubai court revises visitation days in child custody case due to father&#8217;s work schedule"},"content":{"rendered":"<p><strong>A\u00a0father\u2019s work schedule\u00a0became a key factor in a Dubai\u00a0child visitation case\u00a0after a court revised the\u00a0weekly access arrangement, according to a legal consultant.<\/strong><\/p>\n<p><strong>Hassan Elhais, a legal consultant at\u00a0Amal Al Rashedi Lawyers and Legal Consultants, said the father had approached the\u00a0<a href=\"https:\/\/www.professionallawyer.me\/publications\/family-law\/dubai-court-revises-visitation-days-in-child-custody-case-due-to-fathers-work-schedule\">court<\/a>\u00a0seeking more time with his son, including\u00a0regular weekly visits\u00a0and access to\u00a0school-related information.<\/strong><\/p>\n<p><!--more--><\/p>\n<p>According to Elhais, an earlier ruling had allowed the\u00a0<strong>father<\/strong>\u00a0to see his son and take him out out on Saturdays, Sundays and Wednesdays from 4pm to 8pm, along with\u00a0<strong>weekly visits<\/strong>\u00a0to the child\u2019s school in line with school\u00a0<a href=\"https:\/\/www.professionallawyer.me\/legal-articles\/criminal-law\/how-to-navigate-anti-money-laundering-uae-regulations-without-getting-penalized\">regulations<\/a>.<\/p>\n<p>However, the arrangement was later\u00a0<strong>modified on appeal<\/strong>, with Friday replacing one of the\u00a0<a href=\"https:\/\/www.professionallawyer.me\/publications\/family-law\/dubai-court-revises-visitation-days-in-child-custody-case-due-to-fathers-work-schedule\">visitation<\/a>\u00a0days.<\/p>\n<p>Elhais said the court found that the\u00a0<strong>father worked until 5pm on Fridays<\/strong>, making the arrangement difficult to\u00a0<strong>implement in practice<\/strong>\u00a0and limiting\u00a0<strong>meaningful time with his son<\/strong>.<\/p>\n<p>He said the judgment highlighted that\u00a0<strong>visitation schedules<\/strong>\u00a0should be practical and workable for both\u00a0<a href=\"https:\/\/www.professionallawyer.me\/publications\/family-law\/divorced-parents-have-new-rules-to-travel-with-their-children\">parents<\/a>\u00a0while also\u00a0<strong>protecting the child\u2019s wellbeing<\/strong>, studies and\u00a0<strong>daily routine<\/strong>.<\/p>\n<p>The court eventually\u00a0<strong>revised the father\u2019s visitation days<\/strong>\u00a0to Saturdays, Mondays and Wednesdays from 4pm to 8pm.<\/p>\n<p>According to Elhais, the court also considered the\u00a0<strong>mother\u2019s time with the child<\/strong>, noting that granting the father access on both Saturday and Sunday would reduce the time she could spend with her son during her\u00a0<strong>weekly days off<\/strong>.<\/p>\n<p><em>\u201cThis ruling is important because the court did not look at\u00a0<strong>visitation<\/strong>\u00a0as a\u00a0<strong>theoretical right only<\/strong>,\u201d<\/em>\u00a0Elhais said.\u00a0<em>\u201cIt looked at whether the\u00a0<strong>arrangement was workable<\/strong>\u00a0in practice and whether it served the child\u2019s best interests.\u201d<\/em><\/p>\n<p>He added that the judgment reflected how courts in the UAE consider practical issues such as\u00a0<strong>parents&#8217;
