Renewable energy in Ukraine: green auctions launched

In the first half of 2019 alone, renewable energy facilities with a capacity of more than 1.5 GW were connected to the Ukrainian grid, with about 96% of those being solar and wind energy facilities. In the whole of 2018, which has been a record-breaking year so far, numbers were almost half as high. The Ukrainian market also remains very attractive to foreign investors, not least because of the lucrative feed-in tariff rates, which are paid out regularly. Now, after the adoption of the so-called law on green auctions, significant changes can be expected.

Sayenko Kharenko has acted as legal counsel to DTEK Renewables, which manages DTEK projects in renewable energy, on construction of Primorskaya Wind Electric Plant LLC (Primorskaya WEP) with a capacity of 200 MW. Renewable energy in Ukraine: trends to expect in 2019

The alternative energy industry is one of the fastest growing and most attractive sectors for investment in Ukraine. This can be explained, inter alia, by the favorable geographical conditions in Ukraine, where solar radiation is more intense than, for example, in Germany. The wind speed in this Eastern European country makes it possible to develop large-scale wind projects. Moreover, Ukraine has a huge potential in electricity production from biogas, which, in some cases, is already partially being successfully implemented.

CHANGES TO PPA: TO MAKE FINANCIAERS HAPPY

Over the last few months before January 2018, when the latest changes to the power purchase agreements (PPAs) between State Enterprise “Energorynok” and producers of energy from alternative sources were adopted, more than ten agreements were signed with upgraded conditions set earlier in 2017. In the mentioned agreements, the changes to the PPAs were applied and helped bring Ukraine’s PPAs closer to international standards. Nevertheless, the revised PPAs still have a lot of issues that need to be clarified and further elaborated to make them perfectly bankable, and to make them properly executable.

According to the news release circulated by the State Property Fund of Ukraine (“SPFU”) on 21 September 2011 the Cabinet of Ministers of Ukraine adopted a Resolution (the “Resolution”) approving conditions for the sale of stateowned shareholdings in power generation companies Public Joint Stock Company “Kyivenergo” (“Kyivenergo”) and Public Joint Stock Company “Zakhidenergo” (“Zakhidenergo”). A 25% stake in Kyivenergo and a 45,103% stake in Zakhidenergo are offered for sale.
