[South Korea] Amendment to Unfair Competition Law

A bill to amend the Unfair Competition Prevention and Trade Secret Protection Act (the “UCPA”) was promulgated on April 17, 2018, and is scheduled to take effect on July 18, 2018.  The bill introduces significant amendments to the UCPA, namely stipulating store interior designs as business marks and making the unauthorized use of “ideas” an act of unfair competition, thereby substantially expanding the applicability of Subparagraph 1 (j) of Article 2 (“fraudulent use of another person’s product”) of the current (or pre-amendment) UCPA.

Proposed Amendment to the Enforcement Decree of PIPA

Following the amendments to the Personal Information Protection Act (“PIPA”) which took effect on March 29, 2016, the draft of the amendment to the Enforcement Decree was published for comment by the Ministry of Interior (“MOI”, formerly known as the Ministry of Government Administration and Home Affairs) on May 9, 2016. The draft Enforcement Decree provides the specifics of the newly amended PIPA. Key terms of the draft are summarized below.

Background

In connection with the implementation of the Korea-U.S. Free Trade Agreement (the "FTA") (FTA Article 18.9.5., following Section E), the Korean government is to introduce a patent-approval linkage system for pharmaceutical products, similar to the system used in the U.S. To that end, the Korean government has recently amended the Pharmaceutical Affairs Act ("PAA") and the Enforcement Regulation thereof.

Under the current Trademark Act, in a case where the owner of a trademark right wishes to extend the term of the trademark right, the owner must file an Application for a renewal of the term of the trademark right within one year prior to the expiry date of the trademark right, and after the formal examination, the owner must pay the registration fee within two months from the receipt of the Decision to Register the Trademark.

Under the current Trademark Act, the owner of trademark right must pay the registration fee for ten years in a lump-sum within two (2) months from the receipt of the Decision to Register the Trademark.
