Pre-eminent IP boutique Barreda Moller fields one of the largest and most established teams in the market, acting for a raft of global brands and leading domestic companies. Its offering incorporates all aspects of IP protection and prosecution, including patent and copyright infringement litigation. The firm’s 21-lawyer practice is led by Alfredo Barreda and Fernando Barreda, who are both widely respected for their expertise, and also includes Micaela Mujica and Marcela Escobar who are also highlighted for their experience in this area.

IP is a sweet spot at ‘excellentEstudio Echecopar member firm of Baker McKenzie International, where Luis Alonso García has built a market-leading practice appreciated for its swift response, ‘great professional capability’ and ‘very good knowledge of the industry’. Although it provides a fully comprehensive service, the firm shines in IP litigation and recently defended a trade mark in the courts on behalf of a major international healthcare company. Swarovksi, SAP and Banco Santander are clients of a practice that includes Manlio Bassino and Álvaro Gutiérrez.

A highly-recommended option for Peru’, Muñiz, Olaya, Meléndez, Castro, Ono & Herrera Abogados is ‘fast and competent with easy access to professionals and good value for money’. A heavyweight in the field, it boasts five partners, in-house pharmaceutical chemists and an in-house industrial engineer. In overall charge is leading light Marta Fernández Pepper, who is highlighted for her ‘rapid response, high knowledge, precision and good organisation’. Bruno Merchor successfully led advice to Bayer in a judicial challenge to a patent refusal, while Piero Calderón Oliva is advising Microsoft Corporation in a software infringement dispute. Juli Gutierrez left the firm for Diez Canseco Competencia & PI.

Rodrigo, Elías & Medrano – Abogados boasts two leading individuals at the helm of its specialist practice, which is noted for its ‘excellent, 360°, professional handling of legal issues’. Héctor Alvarez and María del Carmen Alvarado have both played active roles in the development of IP law in Peru and now attract an enviable clientele of leading global companies, such as Microsoft, Intel Corporation and Mars. Alvarado successfully opposed a trade mark registration on behalf of PepsiCo attempted by Agroindustrial El Tambo, which went to appeal.

Allende & García Abogados is a new generation IP boutique: seven years old and offering a highly-reactive, partner-led service to a rapidly expanding client base. The ‘excellent’ team of 12 associates is co-directed by Jorge Allende, managing partner Magali Garcia and Dafne Ramos, and provides a ‘high level of commitment and involvement in client issues’, is ‘very efficient’ and ‘makes sure to connect with clients - most importantly, they follow up’. América Móvil, Visa, Red Bull and recent client gain, Colgate-Palmolive are among those who instruct the team. Allende is currently president of the Peruvian Association of Intellectual Property.

Boutique firm BARLaw – Barrera & Asociados S. Civil de R.L. is particularly well-known for its anti-counterfeit work, but is also strong in all facets of brand protection, enforcement and prosecution. Clients range from well-known luxury goods and sportswear brands to automotive manufacturers. Leading names at the firm include founding partners Adriana Barrera and Maria Ines Herrera, who steer 11 additional lawyers, including standout senior associate Catherine Escobedo.

Boutique Estudio Colmenares has been present in the market for over a hundred years, honing its IP expertise in a wide range of matters. It recently defended trade marks on behalf of Robert Bosch, PUMA and Roberto Cavalli; and successfully represented Ferrari in an infringement of rights dispute. Dell and Mattel are also clients. Key names include head of legal María del Carmen Arana, head of patent prosecutions Cynthia Arguedas and Luis Gayoso Frayssinet, head of trade marks.

Durand Abogados is ‘consistently excellent’; its’ lawyers have ‘sophisticated knowledge’ and ‘think creatively while understanding the business goals’. Juan Carlos Durand heads the practice, and together with ‘leading trade mark expert’ Christian Durand, is ‘easy to get along with.’ The firm represents an extensive portfolio of major brands, such as Sony, Visa, Coca-Cola, Starbucks and Warner Bros. Armando Pastor Vera is recommended for patent protection.

Fernández-Dávila & Bueno punches above its weight, most notably in the pharmaceutical and healthcare sectors where it acts for a string of blue chip companies, such as Pfizer, Novatis, Merck and Eli Lilly, recently representing the latter in Supreme Court patent litigation. Non-pharma clients include Diageo and Empresa Nacional de Telecomunicaciones. Carlos Fernández-Dávila Winkler and Ivette Luque are the lead lawyers.

Francisco Espinosa Bellido Abogados is a long-established, IP boutique led by senior partner Francisco Espinosa Bellido alongside his son and third generation managing partner, Francisco Espinosa Reboa. The firm focuses on both registration and protection of trade marks, patent and copyright protection, as well as advertising and consumer protection. The team has a particularly strong track record in litigation.

Osterling Abogados has a ‘very efficient IP department’ which acts for a broad array of industries in the protection of their intellectual property, although the firm has noteworthy experience in the pharmaceutical and cosmetics sectors. Recent mandates included successful registration of a trade mark on appeal for Lancôme and acting for mining company Volcan Compañía Minera in defending its trade mark against a competitor, also on appeal. Senior partner Arturo Tello is highly recommended by clients and heads the practice alongside Ximena Souza Ferreira.

IP boutique BRDA Abogados is a spin-off of top-ranked Barreda Moller, comprising the partner team of Gisella Barreda, José Barreda and Gonzalo Barreda plus one associate. Handling all aspects of IP protection, the team is noted for its ‘great service’ and ‘responsiveness’. It recently advised domestic radio station Spinaca in a copyright dispute and is acting for wholesaler Comercializadora Cobertura Negusa in trade mark litigation.

Casahierro Abogados has a strong practice in the pharmaceutical and agro-chemical industries, as well as in antipiracy work for major film, music and comic book production companies, for example. Recent matters saw department head Javier Duanyand his team handle more than 100 trademark renewals on behalf of Química Suiza, trademark nullity matters on behalf of MD Tech and assist clients in the entertainment sector with the seizure of copyright infringing products in Peru.

Hernández & Cía. Abogados continues to score litigation successes before the courts and regulatory bodies, securing a $1.6m award for client MG Conceptous in a copyright claim against Coca-Cola. Advisory work included acting for Facebook on the IP aspects of a new social media platform for Peruvian corporations and government agencies. Competition and IP specialist Enrique Cavero heads the practice and leads on the majority of matters.

The ‘excellent’ Mónica Germany at Estudio Olaechea is very experienced in the field, attracting high-calibre clients and instructions as a result. She led advice to Tuenti Technologies, a subsidiary of Telefónica, in successfully opposing a trade mark application by Entel, and gained Western Union as a new client. The firm handles the trade mark portfolio of a leading internet company. Senior associate Cristina Fernández is well regarded.

Pacón & Schiantarelli specialises in IP, IT and competition law, and is led by experienced name partners Ana Marí Pacón and Juan Pablo Schiantarelli. They are supported at associate level by Rosalina Susano, Lourdes Gonzales Delgado and Ursula Aguilar Pflucker. Clients have included Nestlé, Telefónica, Eckerd Peru and Media Network Latin America.
