As counsel to developers, financiers and purchasers, Harneys' real estate practice has for decades played a significant role in major real estate development projects in the BVI. The team advises foreign and other investors on the acquisition, ownership, structuring and development of private islands, hotels and resorts, villas, marinas, restaurants and bars, and office buildings; it has particular strength in advising foreign investors on ownership structures to satisfy the tax, regulatory and succession planning needs of clients. Highlights included acting for Road Town Wholesale Trading, a BVI-based retail and wholesale conglomerate, on the approximately $32m sale of a majority stake of its issued shares to a wholly owned subsidiary of The North West Company; the deal included a significant real estate element, including freehold and leasehold property assets. Head of the private client department Sheila George has extensive experience in commercial property acquisitions and disposals and is one of the firm’s principal contacts for inward investment into the BVI. Johann Henry advises local and foreign institutional and private clients on the acquisition and disposal of property and businesses with underlying real estate interests, and assists with major infrastructure development projects. Senior associate Paul Mellor is also highly regarded.

O'Neal Webster is recommended for commercial property developments, its assistance including advice on construction, sales, rentals, title verification, planning and design approval, and financing. Representative matters include acting for international hotel groups and advising in relation to other tourism-related developments in the BVI, landlord and tenants issues, sub-lease and mortgage agreements, environmental laws, and seabed leases. The team also assists with residential purchases and sales. Of counsel Willa Tavernier has principal responsibility for property matters, including contentious and non-contentious real estate issues.

Price Demers & Co is experienced in advising on all aspects of the sale and purchase of commercial and residential real estate in the BVI; this includes handling applications for special licences to own land, filed by prospective owners born outside the BVI. The practice also assists with litigation involving property, including boundary disputes, forfeiture of leases, eviction proceedings, and applications for prescription and partition before both the Registrar of Lands and in the High Court.
