Position

Barrister specialising in EU and competition law. Also specialising in administrative law and human rights. Member of the Treasury B-panel. Standing counsel to the OFT (competition). Recent EU and competition cases include: competition-related judicial review, including Somerfield v Competition Commission, Unichem v OFT, IBA v OFT ; domestic competition appeals, including Apex v OFT, GISC v OFT; competition damages claims, including Scottish NHS v Generic drugs producers; 3Com v Medea; various commercial arbitrations; CFI and ECJ cases, including Microsoft v Commission (intervention), MIT v Deutsches Patent and Markenamt (IP), P&O Ferries (Vizcaya) v Commission (state aid), Eagle v Commission (discrimination); merger cases, including Morrisons/Safeway. Other administrative law cases include: Quark Fishing v Foreign Secretary (HRA damages under A1P1); Hysi v Home Secretary (Art 3 & 8 ECHR); S & K (SIAC).

Career

Qualified 1996; Middle Temple. Daniel Beard specialises in competition, EU, regulatory and public law. He is widely regarded as one of the Bar’s leading specialists in these areas and noted as a ‘first rate’ advocate. He has appeared in courts from Haverfordwest to the Falklands. As well as his domestic work in the High Court, Court of Appeal and the Supreme Court, he regularly appears in the EU Court of Justice and General Court in Luxembourg. Prior to taking silk (as one of the youngest and quickest from call in his round), Daniel was a member of the Attorney General’s A Panel and won ‘Junior of the Year’, for EU and Competition law at the Chambers Bar Awards 2009. He is standing Counsel to the Office of Fair Trading. Daniel has written numerous articles on competition and public law. He was a founder of the Competition Law Journal, Jordan Publishing. He speaks regularly on competition, EU and public law matters and has appeared on the BBC and Channel4 News.
