Position
Barrister specialising in European law, competition law, judicial review, human rights, VAT and customs. Competition work includes advice and representation on domestic and EC competition and mergers law. He has appeared in nearly 100 cases before the European Court, including the Sunday Trading series of cases, Coloroll and subsequent pensions cases, including Preston v Wolverhampton Healthcare and many others in the fields of competition law, tax, free movement of goods, free movements of persons, social security, agriculture, employment and others. Other high-profile appearances include: R v Secretary of State ex p Seymour-Smith, Cadman v Health and Safety Executive, and Coleman v Attridge Law (employment law); Card Protection Plan and Commission v UK (VAT); UK v European Parliament and Council (legislative powers of EC institutions); and Booker Aquaculture v Scottish Ministers (fundamental rights). Recent cases in the UK courts include: MBNA Europe Bank v HMRC; Glaxosmithkline v HM Revenue and Customs; Man ERF v HM Revenue and Customs; Enterprise Liverpool Ltd v Liverpool Mutual Homes; The Law Society v Legal Services Commission; Byrne v Motor Insurers Bureau and Secretary of State for Transport, in which he obtained an order for damages against the Secretary of State for Transport; HMRC v Baxi (VAT); Harland & Wolff Pension Trustees v Aon Consulting Ltd (EC law and pensions); Matthews v Kent Fire Authority (part-time workers directive); Barnet LBC v Ismail (immigration status of EU citizens); and R v Joy and Bossom (fishing quotas).
