Position

Luke is instructed in the most serious and complex criminal cases, for both prosecution and defence. Recent instructions include murder, attempted murder, cybercrime (hacking of Yahoo) and organised crime (multi-million pound supply of cocaine). He has particular expertise in cybercrime. He prosecuted LulzSec, the notorious group of computer hackers whose victims included the FBI, the NHS, News International and the Sony Corporation. He is adept at presenting complex computer evidence at trial.   He represented barrister and recorder Constance Briscoe in her two trials for perverting the course of justice, which arose out of the Chris Huhne/Vicky Pryce “speed points” trial.
Luke has been instructed in a number of high-profile organised crime trials. He was seconded to the Organised Crime Division of the CPS, which provided valuable insight into how such cases are investigated and prepared, and the particular issues that arise (SOCPA agreements; CHIS; PII).
Luke is regularly instructed in matters of white collar crime, including MTIC, commercial and mortgage fraud. He has particular expertise in matters concerning alternative remittance systems such as hawallah and hundi banking.In respect of MTIC fraud Luke has considerable experience representing individuals and companies both in the criminal courts and before the Tax Tribunal.  He is also instructed in matters of bribery and corruption. 
Luke has expertise across the range of proceeds of crime, including: restraint, confiscation (and enforcement), cash forfeiture and civil recovery.
He is regularly instructed in matters of police discipline. He has represented numerous police officers, both at criminal trial and at disciplinary proceedings.
Luke appears regularly in Coronial proceedings.  He prosecutes and defends in matters of health and safety, environmental health, consumer protection, product safety and trading standards.  He appears regularly in matters under the Licensing Act 2003, both in front of local authorities and on appeal to the Magistrates’ Court. He has lectured on the Licensing Act 2003 to the Directorate of Legal Services at the Metropolitan Police.   He is instructed in matters of taxi licensing.

For the CPS, an unled Luke Ponte prosecuted Arthur Collins, the former partner of a The Only Way Is Essex personality, who was convicted of injuring 14 by throwing acid in a nightclub.

Three Raymond Buildings has relationships with both prosecuting authorities and blue-chip criminal and commercial firms, handling work at the interface between traditional criminal fraud and business crime. Michael Borrelli QC represented a defendant in a phishing fraud trial concerning losses of £160m to various corporate institutions, while Helen Malcolm QC represented the solicitor who was convicted in Operation Amazon. Among the junior ranks, Luke Ponte prosecuted as sole counsel the owners of a café, who were convicted of VAT fraud and received custodial sentences.
