Position

Tom Whitehead specialises in all areas of shipping and commercial law including the carriage and sale of goods, international trade, arbitration, jurisdiction and the conflict of laws. He regularly appears in the Admiralty and Commercial Courts and in maritime arbitrations concerning the full range of dry and wet shipping claims. The bulk of Tom’s practice concerns dry shipping work. He also has considerable experience of jurisdiction disputes and claims to anti suit injunctions (both seeking and resisting such orders). Tom is increasingly instructed in insurance litigation and a growing number of shareholder agreement disputes, including LClA arbitration. Recent cases include: US$65m insurance claim arising out of the alleged expropriation of an oil rig by the Government of Venezuela (with Steven Gee QC. LClA arbitration arising out of the collapse of a joint venture between Oligarchs. The claims are in the region of US$30m although final quantum is still to be determined. The Wadi Sudr [2010] 1 Lloyd’s Rep. 193 – The leading case on recognition and enforcement in England and Wales of a foreign judgment obtained from a court in another EU member state in breach of a London arbitration clause under the Judgments Regulation (EU Regulation 4412001); Confidential arbitration arising out of a marine insurance policy. Dispute as to the meaning of ‘damage’ and claim for damages for breach of a London arbitration clause. HlJAZ and IBN HAYYAN – Acted with Vasanti Selvaratnam QC to obtain an anti suit injunction to restrain Kuwaiti proceedings brought in breach of an optional exclusive jurisdiction clause. EDGAR LEHMANN – Tom was instructed to act on behalf of the carrier in litigation concerning a USS3.9 m claim for damage to cargo during shipment.
