Position

David frequently advises on or acts in litigation relating to private client, corporation tax, VAT and customs and duties. He is also very experienced in advising on and appearing in professional negligence and discipline cases arising in a tax context. David was appointed to the Attorney General's C panel in February 2009 and B panel in February 2013 and undertakes work for both taxpayers and HMRC. Recent tax cases include States of Guernsey and Jersey v HMRC (judicial  review of removal of VAT exemption for Channel Island imports), R (Bampton Property Group Ltd) v HMRC (judicial review on refusal of late claims for group relief), Sanderson (discovery assessments), Proteus & Samarkand (film schemes) and Mayes (Chargeable events regime & Ramsay); Birmingham Hippodrome (Set-off time limits) & Sanderson (discovery assessments), Rowe (APNs and PPNs) and Samarkand (film schemes). Qualified to accept Public Access instructions and willing to act under Joint Advisory Scheme and Special Advocacy Scheme.
