Position

Mona’s practice is extensively based within the public, planning and regulatory and also employment groups at Civitas Law. She is recommended in the Legal 500 for her immigration practice in the 2011 directory. Mona is also regarded for her personal injury work, represents both claimants and defendants, and was appointed to the Regional Panel of Treasury Counsel in 2010. Public law: Mona has an extensive public law practice that includes housing cases (acting for both claimants and defendants) including contested applications for possession on grounds of rent arrears, nuisance, and other breaches of tenancy agreement. Also able to undertake work for both the local authority and defendants in applications for anti-social behaviour injunctions, including committal proceedings. Mona has a particular interest in asylum and immigration law and has developed an extensive practice involving complex issues surrounding the grant of asylum and/or humanitarian protection as well as cases involving the application of the immigration rules. Mona has conducted a number of cases covering asylum appeals, appeals against entry clearance officer decisions in relation to settlement of children and other family members. Mona has also been involved in contested bail applications as well as appeals against refusals for a grant of indefinite leave to remain. Mona’s experience extends to the Upper Tier Tribunal and has experience of advising on and drafting grounds of appeal and applications for permission. Mona was noted in Legal 500 for her ‘substantial immigration practice’. Since being appointed to the Regional Panel of Treasury Counsel in 2010, Mona as gained experience in acting for a number of government departments, defending different types of judicial review claims. In particular, Mona has acted for the Home office in Immigration claims and for the Department of Work and Pensions in claims brought against the Child Maintenance and Enforcement Commission. This area of practice is one in which Mona is very keen to expand. Mona has also represented the UKBA in a number of civil penalty appeal cases. Mona also has a wide range of experience acting for both the Local Authority and Defendants in a broad range of regulatory matters in both the Magistrates’ and Crown Courts. Has also represented Government bodies including consumer protection including cases under the Trade Descriptions Act, Trade Marks Act and Product Safety Regulations, benefit fraud, environmental protection, planning, licensing, including underage alcohol sales, appeals against licensing committee decisions, and offences committed in breach of taxi licensing laws, anti-social behaviour orders and Proceeds of Crime Act applications. Employment law: Mona’s experience both in terms of Tribunal hearings and advisory work ranges includes claims involving: routine unlawful deduction of wages claims; unfair dismissal claims (including cases involving dismissals relating to public interest disclosure); constructive dismissal claims; complaints on behalf of trade unions to the tribunal where employers have failed to inform and consult appropriate representatives of affected employees of a TUPE transfer; age discrimination in relation to pension schemes; sex discrimination and exercise of parental rights; race discrimination; disability discrimination. Mona has also had experience in dealing with claims brought under TUPE regulations, determining points on the extent of the Tribunal’s jurisdiction to hear claims, advising on merits in applications to extending time limits on just and equitable grounds, advising and conducting remedy hearings, including substantial claims involving pension loss calculations Mona acts for both claimants and respondents. However, since being appointed to the Regional Panel of Treasury Counsel in 2010, she has acted more regularly for Respondents. She has been involved in a number of unfair dismissal cases at employment tribunal level. Recently, in December 2011, Mona successfully acted for a government agency in a discrimination claim which centred around disability and victimisation issues. In October 2011, Mona was successful in a strike out application for a government agency that had dismissed an employee on the basis of highly sensitive gross misconduct. Personal injury: Mona has an extensive personal injury practice. She has experience in road traffic matters, occupier’s liability and employer’s liability including stress at work claims and occupational illness. Since being appointed to the Regional Panel of Treasury Counsel in 2010, Mona has acted in a number of interesting personal injury actions, including claims brought against the Ministry of Justice, the Ministry of Defence and the DVLA. As well as acting for Defendants, Mona acts for Claimants through their unions and under conditional fee arrangements in all variety of claims. She also has experience of acting for claimants under the Criminal Injuries Compensation Scheme. Mona has considerable experience in advisory work, settling pleadings, including schedules of special damages and counter schedules and her advocacy experience includes the High Court.
