Position

Will practices in the areas of commercial, public law, construction law and employment law. In his commercial practice he has advised on numerous cases involving disputes over title, hire purchase agreements, dealings by mercantile agents, fraud, sales by auction and misrepresentation/false descriptions. These matters have included advising a private seller on the title to his vehicle, where an intermediary had held himself out as a seller and fraudulently taken out a log book loan on a large number of high-value vehicles. Having been required to surrender his claim to the vehicle by a major finance company, Will’s advice maintained his claim to title and lead to a favourable settlement. Will has also advised numerous corporate clients. Having previously worked in finance and banking, he has an in-depth awareness of commercial issues and an understanding of accounting and corporate finance. Will’s public law practice has included representing local authorities in a range of matters including public works to the highways, the application of the Highways Act 1980, as well as mental health cases and the recovery of council tax. In addition Will has appeared in front of the Upper Tribunal for an issue surrounding backdating. Will’s construction law practice has involved both claims before the Technology and Construction Court, and advising and drafting on an adjudication, valued in excess of £500,000, involving issues of non-payment, breach of contract and repudiation which resulted in a favourable settlement for his client against a nationwide employer. Will also appears regularly before the employment tribunal for both applicants and respondents. He has dealt with claims involving unfair dismissal, sex discrimination, race discrimination, indirect discrimination, whistle-blowing, harassment and holiday entitlement. In particular he has dealt with specific issues of discrimination by third party contractors and rolled up holiday pay in the construction industry.
