Position

Barrister specialising in costs litigation, professional negligence and clinical negligence. Costs practice involves all areas of costs law, including inter partes and solicitor-client disputes, funding arrangements, wasted and non-party costs orders. International clients include law firms in Singapore, Dubai and the Channel Islands. Professional negligence practice is primarily defendant with an emphasis on solicitors, barristers, surveyors and accountants. A particular interest in limitation with appearances in reported cases. Clinical negligence practice involves injuries up to maximum severity. Recent notable cases: Excalibur Ventures LLC v Texas Keystone Inc and Others [2014] EWHC 3436 (Comm) (application for a non-party costs order against a funder where the costs totalled around £25m); Mount Eden Land Ltd v Speechly Bircham LLP [2014] EWHC 169 (QB) (appeal arising out of a Solicitors Act assessment); Flatman v Germany [2013] EWCA Civ 278 (liability of solicitors to pay costs as non-parties); Simmons v Castle [2012] EWCA Civ 1288 (implementation of general damages increase as part of Jackson reforms); Lane v Cullens [2011] EWCA Civ 547 (limitation in a solicitors’ negligence claim); Bowling & Co v Edehomo [2011] EWHC 393 (Ch) (limitation in a solicitors’ negligence claim); Morgan v The Spirit Group [2011] EWCA Civ 68 (requirements of a summary assessment of costs).

William Flenley QC acted for the defendants in Group Seven v Nasir & Notable which involved an €100m fraud and a claim for €12m. He also led Jamie Carpenter in defending the solicitors in a Court of Appeal case, which involved a managed group of 100 claims, brought by claimants who had bought holiday homes in southern Italy. Michael Pooles QC acted for the defendant solicitors in Thomas v Hugh James , leading Matthew Jackson.
