Position
His practice in 2009 continues to encompass a broad range of areas including unfair dismissal, discrimination, TUPE claims, protective awards and claims involving harassment and stress at work, in addition to cases with a transnational element: Diggins v Condor Marine Crewing Services Ltd [2009] EWCA Civ 1133; and other confidential cases. Personal injury: his practice in 2009 has developed to include cases involving head injury and injuries of the utmost severity. He maintains a particular interest in accidents outside the jurisdiction, including holiday claims, road traffic accident claims and employer’s liability. Significant work/cases over past 12 months include: Cass v PGS and others; and other confidential cases. Travel: he has appeared in the two leading cases in the High Court: (1) for the French insurers in Knight v AXA in relation to the characterisation of a damages claim for personal injury claims against a foreign road traffic insurer where the accident occurred abroad, and determining the proper law for the determination of interest; (2) for the claimant in a claim against the Motor Insurers Bureau acting in its capacity as a compensation body; the first case in the UK (and possibly the EU) involving arguments over the application of the Rome II Regulation on the proper law governing non-contractual obligations. He has advised extensively on the application of the Brussels Regulation and jurisdiction issues, and the new rules which apply under the Rome II Regulation. Significant work/case highlights over the past 12 months include: Clinton Jacobs v Motor Insurers Bureau; Tim Knight v AXA Assurances; and other confidential cases.
