Personal injury, clinical negligence.

Position

Nigel is the current chairman of the Personal Injuries Bar Association and a former member of Civil Justice Council. He has specialised in personal injury litigation for many years and his areas of specialisation include: brain and spinal injuries, industrial disease and stress as well as CFA related costs matters. He also acts in multi-party litigation and cases involving accidents abroad. Over the last year he has acted in numerous cases involving multi-million pound settlements, including those with periodical payments orders. His most recent substantial trial was on behalf of claimant in Sklair v Haycock [2009] EWHC 3328(QB), a seven day hearing resulting in a award of £3.38m to a man who already had severe pre-existing mental disorders where Edwards Stuart J refused to set off the care that the claimant would have required in any event in due course against the private care package sought on behalf of the claimant. He is currently acting inter alia in catastrophic injury cases following accidents in Jersey(2) and Malta and in a case where the claimant’s local authority is intervening to argue that the defendant should pay for all past and future care costs despite the local authority’s statutory obligations. Significant work/case highlights over the past 12 months include: Sklair v Haycock [2009] EWHC 3328(QB); Ibrahim v Ibrahim; Re Medcraft; re Butler; ce and Thompson v NDLB; Garry v Le Mercier.
