James Brightwell
Position
Specialises in contentious and non-contentious trusts and estates and commercial chancery litigation. Has particular experience of trust litigation and trustee applications, the variation of trusts, trusts of land and claims concerning professional liability in private client business. Much of his work involves offshore trusts and he has particular experience of claims for breach of trust and fiduciary duty and of issues concerning the removal of trustees and personal representatives. Recent cases include Alhamrani v Alhamrani (Jersey), Alhamrani v Alhamrani (BVI), Chemtrade v Fuchs Petrolub, High Commissioner for Pakistan v National Westminster Bank, lnvestec Trust (Guernsey) Limited v Oscatello, Gledhill v Arnold, Schomberg v Taylor, Trustee W v Attorney-General (Bermuda), Lemos v Lemos.
Career
Called 2000; Lincoln’s Inn; Deputy District Judge (civil) 2010. Called to the Bar of the Eastern Caribbean in the British Virgin Islands; and of Bermuda (ad hoc, 2015); Co-author ‘Lewin on Trusts’, 19th edition and 2nd supplement; ‘Atkin’s Court Forms (Nuisance)’; ‘Halsbury’s Laws (Income Taxation)’.
