Position
A broad Chancery practice in London and the North-East of England. One of the few London Chancery practitioners with a major court presence in Manchester, Leeds and Bradford. She undertakes a wide range of contentious and non-contentious work with an emphasis on: family provision (Inheritance Act claims); wills, probate and the administration of estates; real property; co-ownership disputes, Trusts of Land claims (TOLATA); insolvency – personal insolvency and corporate insolvency. Significant cases include: Sagicor General Insurance (Cayman) Ltd v Crawford Adjusters Ltd (Nov 2008) (Grand Court of the Cayman Islands – involving claims of breaches of fiduciary duty, breaches of contract, fraud and conspiracy as against loss adjusters, project managers and construction companies; as above – counterclaim involving tort of abuse of process (collateral purpose); Pitcairn v Maples & Calder (2009) (Grand Court of the Cayman Islands – involving the issuing of Caymanian work permits and breach of promise); Moss v Moss and Moss Deceased (2004) (High Court – junior to Eleanor Hamilton QC and David Rose in claim by widow of short marriage in a £20m estate). Typical recent cases include: Re M Deceased (2010) (1975 Act claim – representing the beneficiaries in a claim brought against the estate by surviving spouse – spouse 98 years of age – issues of life interest versus capital lump sum in view of claimant’s age); Re A Deceased (2009) (representing stepson claimant in multi-party 1975 Act claim in £5m estate); Re G v S (2009) (TOLATA three-day trial – the claimant failed to establish a constructive trust in circumstances where it was common ground that there had been significant financial and physical contribution to the property – the claimant failing to prove agreement); Re B Deceased (2009) (deceased’s will challenged successfully on the grounds of incapacity – undue influence not found). Also has a special interest in matrimonial finance and ancillary relief, advising and acting in all areas of matrimonial finance, particularly proceedings involving private companies or partnerships and third-party interests. Frequently appears for interveners in ancillary relief proceedings and is experienced in both pursuing and defending section 37 applications. Typical recent cases include: Re Mehmood (2010) (representing the interests of interveners in ancillary relief proceedings – third-party interests in the former matrimonial home determined in TOLATA proceedings before Chancery District Registry); Re K (2010) (represented H in W’s section 37 application to set aside sale of international property – tracing of proceeds of sale); Re K v B (2010) (represented W in very short marriage – W substantial financial contribution – treatment of mortgage-free FMH brought into marriage by W application of Rossi v Rossi); Re Begum (2009) (six-day ancillary relief hearing representing W – determining the extent of third-party interests in a portfolio of domestic and international properties to establish true matrimonial assets).
