RIPA 2000 – current and future issues

August 2012

The Regulation of Investigatory Powers Act 2000 has featured prominently in print, online and television media this week following the report by Big Brother Watch entitled “A legacy of suspicion: how RIPA has been used by local authorities and public bodies” (available here).

The report uses as its case study the Investigatory Powers Tribunal’s decision in Paton v Poole Borough Council, in which 11KBW’s Ben Hooper appeared. In addition, Robin Hopkins was a studio guest on ITV’s news at 1:30 on 22nd August discussing forthcoming developments in RIPA.

    The lower courts continue to clarify the position following the decisions of the Supreme Court in Manchester City Council v Pinnock [2010] UKSC 45; [2011] 2 AC 104 and Hounslow London Borough Council v Powell [2011] UKSC 8; [2011] 2 AC 18 on the application of Article 8 ECHR to defend possession proceedings.
