Position

Barrister specialising in public law: judicial review; local government: vires, capital finance, Localism Act powers, public procurement, community care, political balance and monitoring officer issues, local authority and health body disputes, information law, including environmental information (advising and representing information commissioner and public authorities, acting in over 30 Information Tribunal appeals), data protection, and education (including academies, further and higher education). Represented 14 local authorities in the interest rate swap restitution litigation between local authorities and banks. Complex district auditor investigations and proceedings against local authorities, has acted for auditor and public body respectively. Cases include: R v Richmond LBC ex parte; McCarthy and Stone Developments Ltd [1992] 2 AC 48 (HL) (charging for services); Ealing Community Transport Ltd v Ealing LBC [1999] COD 492 (CA) (public procurement); R(L) v Governors of J School [2003] 2 WLR 528 (HL) (teachers’ industrial action where pupil entitled to be reinstated after appeal against school exclusion); R (Swords) v Secretary of State for Communities and Local Government [2008] HLR 17 (housing stock transfers); R (Daskaloulis) v University of Western England [2008] EWHC 2981 (Admin) (retaking university exams); R (Crouch) v Secretary of State for Health [2009] ICR 461 (terms of NHS dentists’ contracts); Suppiah v Secretary of State for the Home Office [2011] EWHC 2 (Admin) (unlawful detention of unsuccessful asylum-seekers with their families, disclosure of Local Safeguarding Children Board report); R (Omotosho) v The Governing body of Harris Academy Crystal Palace [2011] EWHC 3350 (Admin) (academy school’s admissions arrangements and appeals); R (UNISON) v Wiltshire NHS Primary Care Trust and Others [2012] EWHC 624 (Admin) (trade union’s standing to bring judicial review challenge to NHS Trusts’ alleged proposed breach of procurement law and public law); R (Hunt) v North Somerset Council [2013] 16 CCLR 502 (CA) (challenge to council budget concerning youth services, SC forthcoming 2015); R (Lewisham London Borough Council and Others) v AQA and Ofqual [2013] EWHC 21 (Admin) (judicial review concerning English GCSEs); R (Branwell) v Rochdale MBC [2013] EWHC 1024 (challenge to council tax reduction scheme).

Career

Qualified 1985; Middle Temple; has practised at the Bar since 1986, with various periods of family leave.

  • Possession Proceedings 28 August 2012

    The lower courts continue to clarify the position following the decisions of the Supreme Court in Manchester City Council v Pinnock [2010] UKSC 45; [2011] 2 AC 104 and Hounslow London Borough Council v Powell [2011] UKSC 8; [2011] 2 AC 18 on the application of Article 8 ECHR to defend possession proceedings.
