They were announced on 25th January 2012. The proposals consisted of two main elements: a draft Regulation, dealing generally with data protection (the General Data Protection Regulation); and a draft Directive relating to the processing of personal data within the criminal justice system.

High Court makes pro bono costs order in healthcare judicial review

Following the grant of permission to bring judicial review proceedings brought by a patient group, “FOBS”, to challenge a decision of the Northumberland Care Trust to make cuts to one of the UK’s most rural GP surgeries, the Care Trust has agreed to re-take the impugned decision.

Global Warming Policy Foundation: Tribunal to consider disclosure of donor identity

The Guardian reports this week that the First-Tier Tribunal (Information Rights) will hear the appeal of Montague v Information Commissioner on Friday 27 January. The disputed information is the identity of one of the founding donors to the Global Warming Policy Foundation, a climate change sceptic thinktank chaired by former Chancellor Lord Lawson.

Procurement update: Court of Appeal rules on service concessions and implied contract claims

In JBW Ltd v Ministry of Justice [2012] EWCA Civ 8 (16 January 2011), the Court of Appeal has analysed and applied recent Court of Justice case-law on the definition of “services concession” contract and made an important ruling on the availability in procurement litigation of claims based on an implied contract created by an invitation to tender.

Greenwich Community Law Centre: High Court upholds withdrawal of funding from law centre

In R (Greenwich Community Law Centre) v Greenwich LBC [2011] EWHC 3463 (Admin), the Administrative Court (Cranston J) has dismissed a challenge by a leading law centre to the decision by Greenwich Council to withdraw its funding of around £200,000 per year.

The EAT has delivered judgment in this the first case to consider the “supply of goods” exception to the service provision change rules in the Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”). The case concerned the supply of axle assemblies for vans built by a company within the General Motors group. James Goudie QC and Holly Stout appeared for two out of the three respondents. Clear Edge UK Ltd v Elliot and others [2011] EWHC 3376 (QB)

Akhlaq Choudhury was junior counsel for the Claimants in this application for springboard injunctive relief in a team move context. The case was unusual in that the “team” comprised only three people and all of them had given due contractual notice of their termination (which notice had already expired in respect of two of the Defendants by the time of the application).

Gender reassignment discrimination claim upheld by Employment Tribunal

An Employment Tribunal has decided that Miss Abigail Lawrence, who worked as a receptionist at a massage sauna near Nottingham with a predominantly homosexual and bisexual clientele, was discriminated against during her employment, and on dismissal, on the grounds that she was undergoing a process of gender reassignment from male to female, and (once she had legally become a female part way through her employment) on the grounds of her sex.

Protective Costs Order granted to allow judicial review challenge to cuts to rural GP surgeries

Following an oral hearing at the Administrative Court sitting in Leeds, Mr Justice King has granted permission to apply for judicial review to a patient group of one of the UK’s most rural GP surgeries, in respect of funding decisions made by the Northumberland Care Trust, including to withdraw certain payments previously made to surgeries in the region on account of their “rurality” and size.
