Position
Rosemary is an extradition specialist and the co-author and assistant editor of the ‘Extradition and Mutual Legal Assistance Handbook’. She has extensive experience prosecuting and defending persons in the UK facing extradition abroad, both at first instance and on appeal. In addition, she advises persons who are facing extradition, or have been extradited, to the UK. Rosemary also appears for the Secretary of State in extradition appeals and in judicial reviews. Rosemary spent seven months on secondment to the Crown Prosecution Service extradition section and continues to accept instructions to draft European Arrest Warrants and extradition requests on behalf of UK authorities. (R v Royston Jones [2011] EWCA Crim 107 appeared for the defendant in a successful appeal overturning a conviction imposed in breach of the speciality rules; Kaminski v President of the Regional Court in Tarnow [2010] EWHC 2772 (Admin) appeared for the requested person a case concerning extradition appeal procedure). Rosemary’s practice encompasses all areas of criminal law, including confiscation, asset recovery and appellate work. Rosemary has prosecuted and defended in cases ranging from serious dishonesty and fraud, to section 18 assaults and sexual assault. She has been led as junior counsel in cases of drugs importation, serious fraud, arson and attempted murder (R v E (Court of Appeal, 2011): Rosemary is currently instructed as junior counsel for the prosecution in a CCRC referral to the Court of Appeal; R v S (Southwark Crown Court, 2010): junior counsel for the prosecution in a police corruption case). Rosemary’s practice encompasses a wide range of public law and human rights, with particular emphasis on immigration and prison law. She is currently instructed as junior counsel for the Ministry of Defence in a case involving a large number of personal injury claims brought by Iraqi civilians who allege that they suffered mistreatment at the hands of UK forces in Iraq. Rosemary has a wide experience of prison law. She has acted in parole hearings, judicial reviews, as well as private law claims brought by prisoners. Her experience includes challenges to re-categorisation decisions, licence recalls, visiting orders, Rule 39 (privileged post) violations, as well as prison healthcare. (R (PA) v Secretary of State for Justice [2011] EWHC 704 (Admin): judicial review of the Secretary of State’s refusal to grant a mentally ill prisoner early release on home detention curfew; R (Paul Smith) v Secretary of State for Justice [2011] EWHC 81 (Admin): appeared for the Secretary of State in a judicial review of a licence recall decision). Rosemary’s immigration experience includes cases in the tribunal system, as well as on judicial review. She has appeared in cases relating to asylum and human rights, deportation, challenges to certification under the Nationality Immigration and Asylum Act 2002, and fresh claims. Rosemary also appears in national security cases before the Special Immigration Appeals Commission.
