Recent case highlights include R (Uber) v Transport for London where, using free movement and non-discrimination arguments, Thomas de la Mare QC and Hanif Mussa secured a short-term reprieve for Uber, following TfL’s earlier refusal to renew the ride-sharing company’s operating licence in September 2017. Nathalie Lieven QC and Ravi Mehta acted for the successful claimant in R (ClientEarth (No 3)) which found the government’s air quality plan unlawful under the EU’s Air Quality Directive. And Kieron Beal QC secured a reference to the CJEU for an NGO claiming EU legislation fails to recognise the independent status of Western Sahara; Brian Kennelly QC and Paul Luckhurst appeared for respondents HMRC and Defra in the hearing.
