Position
Barrister specialising in commercial fraud and asset recovery, banking and professional negligence. Particular expertise in complex mortgage fraud cases. Currently acting in several high-value claims involving allegations of bribery and corruption. Has considerable experience of complex and high value freezing orders, simultaneous execution search orders and disclosures/delivery up orders. Experience of a broad range of professional negligence actions and trials, including accountants, auditors, financial advisers, solicitors, barristers, insurance brokers and construction professionals. Cases include: AB v XY (Ch D 2010) high-value claim for damages and declaratory relief arising out of a complex mortgage fraud involving a portfolio of over 1000 properties; Jewson v Newman (QBD 2008) multimillion-pound claim involving bribery, breach of fiduciary duty and conspiracy; RCPO v (1) R (2) Lloyds TSB [2007] EWHC 2393 (Admin) contempt, interference with administration of justice, banking, restraint orders; K Limited v National Westminster Bank [2007] 1 WLR 311, [2006] 4 All ER 907, [2006] 2 Lloyd’s Rep 569 – leading decision on construction of Part VII of POCA and bankers duty to freeze accounts while investigations are made by SOCA; EFT v SS for Home Department and others [2006] 1 WLR 1316, [2006] 4 All ER 285, [2006] ACD 8 (Administrative Court) fraud, search warrants, judicial review, scope of investigatory powers of SFO under s2 CJA 1987.
