Position

Gerald practises in all fields of gaming, liquor and entertainment licensing. Appears at first instance before licensing committees throughout England and Wales, and also the licensing boards of Scotland. Appellate work, both for and against licensing authorities, takes him before tribunals ranging from magistrates’ courts to the House of Lords. Considerable experience in the Administrative Court makes him much sought-after in the many High Court challenges spawned by the recent and comprehensive legislative overhaul of liquor, entertainment and gambling (The Licensing Act 2003 and The Gambling Act 2005). Appeared for successful claimant in Betting Shop Services Ltd v Southend-on-Sea Borough Council (2008) 72 LR 20 (licensing authority not bound to follow Gambling Commission’s guidance), and for the interested party (Movida) in R on the application of Westminster City Council v Metropolitan Stipendary Magistrate [2008] EWCH 1202 (admin) (certainty of conditions attached to premises license).
