Position

Specialising in personal injury, clinical negligence and health and safety litigation, represents both pursuer and defender. Has extensive experience in conducting litigation in both the Court of Session and Sheriff Courts, including large-scale and complex litigation, fatal accident inquiries and public inquiries. Appointed as temporary Junior Counsel to Advocate General. Recent cases include: Heather Bruce and others v Tayside Health Board, [2017] CSOH 123 (medical negligence proof on causation), Alan Cairns v Dundee City Council, [20170 CSOH 86 (proof on liability), Lynda Brabender, representing Kaiden Ward v Fife Health Board, [2016] CSOH 168, (medical negligence proof on liability); Elizabeth Gilchrist v Asda Stores Ltd [2015] CSOH 77 (proof on liability, the first case to consider the impact of the Enterprise and Regulatory Reform Act 2013 on the application of ‘six pack’ regulations in relation to an accident at work.); Adam Wagner v Thomas Grand and Arla Foods UK Plc [2015] CSOH 51 (proof on liability, and quantum re prosthetics) and [2016] CSIH 34 (appeal); Anne MacKinnon v Thomas Hadfield [2014] CSOH 15 (proof on quantum); James Farmer v FTV Proclad [2013] CSOH 165 (proof on liability) John Cowan v Hopetoun House [2013] CSOH 9 (proof on liability); Fiona Dickie v Mohammadreza Khandani [2012] CSOH 122 (proof on quantum); Zanna Marczenko v Freshlink Foods, Lady Clark of Calton, unreported. 2012 (proof on liability)

Career

Admitted to Faculty of Advocates July 2005. Trained with Dundas & Wilson CS 1996 to 1998, then became prosecutor with COPFS. Part of Lockerbie trial team, and lead operational policy team in Crown Office. Ll.B (Hons) (Edinburgh Universtiy) (1995); Dip.LP (Edinburgh University) (1996); Diploma in Forensic Medicine (Glasgow University) (2001).
