Principal areas of practice: serious and organised crime, corporate financial crime, regulatory crime, public and fatal accident inquiries, domestic and international arbitration. Serious crime: Mark has extensive experience in all forms of serious and organised crime which come before the High Court. Mark has experience in cases of murder, firearms crime and drug-related prosecutions, both as a senior advocate depute and defence counsel. His experience in corporate financial crime extends to appearing in cases of commercial fraud and embezzlement involving professional, public service and employee accused. He also has experience in both criminal and civil litigation under the bankruptcy and insolvency legislation. Mark has been instructed regularly, and provides advice at a preliminary stage if requested, in relation to all aspects of investigations and prosecutions brought under the proceeds of crime and related legislation. Regulatory crime: Mark has experience of many aspects of regulatory crime and proceedings, including: prosecutions brought under firearms legislation; prosecutions brought under all of the main wildlife protection legislation; prosecutions relating to property mis-description; aviation offences: prosecutions brought under the Road Traffic Act, with particular experience of cases brought under sections 1, 2B and 3A of the Road Traffic Act 1988; and prosecutions brought under the provisions of the Health and Safety at Work Act 1974. Courts martial: as part of a wide and varied practice, Mark has also appeared in a number of courts martial for accused serving with the Royal Air Force and Royal Marines and was involved in the defence of a foreign national accused in international torture proceedings. Mark has appeared in a number of fatal accident inquiries and has an interest in all inquiry work. Mark has an interest in domestic and international arbitration and is a member of the Chartered Institute of Arbitrators (CIArb), the Scottish Arbitration Centre and the Faculty of Advocates Dispute Resolution Service. Recent representative cases include: Snowman/ Jim Clark Rally FAI, instructed on behalf of Highland Car Club; In Re Death of Ciaran Williamson FAI, instructed on behalf of Glasgow City Council; HM Advocate v Charles Green & Others, instructed on behalf of former Chief Executive of Rangers Football Club in High Court proceedings concerning the acquisition of Rangers.
