Position
Extensive litigation practice in the Court of Session, High Court and the Supreme Court. Cases before the Judicial Committee of the House of Lords have included RHM Bakeries plc v Strathclyde Regional Council (property/nuisance); Herd v Clyde Helicopters plc (Warsaw Convention); Elf Caledonia v Wood Group & Others (indemnity and insurance re Piper Alpha); Land Securities plc v Scottish Ministers [2006] UKHL 48; Clark v Fennoscandia [2007] UKHL 56; Hamilton & Stebbings Inc v Allied Domecq [2007] UKHL 33. Inveresk plc v Tullis Russell Ltd (2010); Morrison Sports Ltd v Scottish Power (2010). Appeared before the Committee for Privileges of the House of Lords in Lord Gray’s Question (House of Lords Bill). Construction litigation has included The Storebaelt Tunnel (Danish Court of Arbitration), Faslane Submarine Base (Court of Session) and The Scottish Parliament Building (Commercial Court). Appeared for the second accused Lamin Fhima before the High Court of Justice as constituted by Statutory Instrument in the Netherlands (The Pan Am/Lockerbie Bombing). International arbitrations have included instruction from Chinese National Petroleum Corporation and a number of major financial institutions. Appearances at Public Inquiries have included representation of the re insurers and insurers at Lord Cullen’s inquiry into the Piper Alpha disaster.
