Work Department

Personal injury either side, clinical negligence either side, professional negligence.

Principally in three areas: high value and/or complex personal injury work; clinical negligence and defending fraudulent compensation claims. Henry works for both claimants and defendants with an emphasis on more serious injuries, such as brain injury, spinal injury, amputation cases and fatal accidents and claims for periodical payments and provisional damages (including a claim in 2012 which concluded on a periodical payment basis, but with a lump sum equivalent value in excess of £8m). This work spans employer’s liability (including disease work; asbestos, dermatitis, deafness, WRULD etc.), public liability (with particular experience of highways claims), road traffic (including claims involving the MIB), criminal injuries (including a recent CICA case which concluded for approximately £3.7m), inquests and consumer protection. Henry has experience of group litigation, having been part of the lead claimants’ team in the recent Linkwise ‘sofa litigation’, with several thousand successful claims having been concluded. A wide range of clinical negligence work is undertaken by Henry. Some of the more serious and interesting recent cases have included failures to diagnose cancer, a sub-dural haemorrage and infant hip dysplasia. Instructions have been received in relation to numerous injuries sustained shortly prior to or during birth (such as cerebral palsy, avoidable still birth causing "nervous shock" to the parents and orthopaedic injuries sustained during caesarian section). Henry has been instructed in many cases involving allegedly negligent surgery: such as termination of pregnancy, removal of gall bladder, hip replacement, hernia repair and unnecessary removal of ovarian cyst. He has advised in relation to negligent private fertility treatment and the negligent prescription of diazepam. Regular instructions are received from insurers in relation to fraudulent personal injury claims, often but not exclusively arising out of actual or alleged road traffic accidents. Henry has significant experience of defending claims involving allegations of staged accident, induced accident, bogus passenger and low velocity impact. He also acts in relation to large and complex fraud rings.

Studied law at Worcester College, Oxford University, before taking the bar course in London. Following successful completion of pupillage, Henry took tenancy at 22 Old Buildings, Lincoln’s Inn (now 42 Bedford Row), before moving to No5 Chambers in January 2003. Publications: Henry is a contributing editor to Butterworths Personal Injury Litigation Service.
