Position

Louise undertakes a wide variety of contentious probate work including advising on the construction of wills and trusts, and Inheritance Act claims. She recently represented the defendant to an Inheritance Act claim, in a 2-day High Court trial. The case involved unusual facts, as the defendant asserted that marriage of the deceased to the claimant spouse was a sham marriage. Louise also regularly advises and drafts pleadings in trusts cases. Her strengths and main interests lie in the more complicated and technical aspects of the law in these areas. She enjoys practising across a spectrum of land and property work. She regularly advises and represents both claimants and defendants in TOLATA matters and has experience of disputes over rights of way and boundaries, and proprietary estoppel. Louise also deals with a wide range of contractual and commercial disputes including breach of contract and misrepresentation claims, together with sale of goods, hire purchase agreements and insolvency matters. Louise has experience in the Court of Protection, and has been involved in cases dealing with the welfare and financial arrangements for elderly adults without capacity, particularly where there are family disputes about such matters. In addition Louise enjoys a growing employment practice and has extensive experience successfully representing claimants and respondents at tribunal. She has experience of multi-day tribunal hearings and regularly undertakes work in the areas of unfair dismissal, wrongful dismissal, and all aspects of discrimination. She also has a practice of drafting ETls and responses, together with witness statements and enjoys advising both on paper and in conference. Louise strives to deliver both to her professional and lay clients and prides herself on her ability to build a good rapport with those whom she represents. Louise has had exposure to a wide variety of court work and tribunals which provides her with a strong practical base as she looks to build upon her growing specialisms. She has experience of hearings at all levels in the County and High Courts, including multi-day trials.

    The Presidium of the Supreme Commercial Court of the Russian Federation (hereinafter - SCC RF) adopted by the Informative Letter No. 156 dated the 26th of February, 2013 (hereinafter - the Informative Letter) on Review of the consideration by arbitrazh courts of the cases on the implementation of the public order clause as the ground for rejection of the recognition and enforcement of the foreign court decisions and arbitral awards.
  • China Customs New Interpretation

    For many products, tariff classification can be technically complex, confusing, and subject to multiple interpretations. Often several different Harmonized System Codes ("HS Code") may seem applicable for one given product with different tariff rates. Tariff classification is indeed a process of application of customs classification rules, including customs rulings and decisions, and misclassification may trigger severe legal consequences. The sad fact is, unfortunately, that many companies rely on non-legal professionals to determine the HS Codes for imports or exports. A recent interpretation issued by the General Administration of Customs of China ("GACC") (Circular No. [2012] 495 Shu-Fa-Fa) (the "Interpretation") reinforces the process of tariff classification as a legal matter, and formulates the test as to what counts for regulatory violation if tariff classification rules are improperly applied by the importer or exporter in a given case. If the legal defense is successful, misclassification may only be treated as a non-violation misclassification, with the possible obligation to pay up additional customs duties, if any, but without administrative or criminal consequences. The Interpretation took effect as from February 1, 2013.
