Position

James McClelland practices in commercial, public and regulatory law. His commercial practice spans banking, fraud, insurance/reinsurance, professional negligence, aviation and a wide variety of other commercial and chancery disputes involving claims in contract, tort and equity. His cases frequently have an international dimension. James’ public and regulatory work is centred upon financial and legal services regulation, however James has acted for and against a wide variety of public bodies (including both national and local government) and he has particular experience of and interest in judicial review proceedings. James acted for Halifax/Bank of Scotland against the OFT in the landmark bank charges test litigation; acted for the SRA in the Coal Miners Compensation Scheme prosecutions; and is currently acting for the FSA resisting a judicial review by the British Bankers Association of its PPI compensation provisions.

Called 2004, Lincoln’s Inn. Appointed junior counsel to the Crown (C Panel) 2004. Co-author of ‘The Law of Bank Payments’ (Sweet & Maxwell, fourth edition, 2010); co-author of ‘The Law of Regulation’ (OUP, forthcoming).
