Position

Rachael is a barrister who specialises in complex high-value construction/commercial disputes and litigation. She is instructed as a junior and in her own right. She is instructed by a range of parties, including: commercial parties; governmental departments and local authorities; and private individuals. Recently, she has been instructed in relation to disputes which have arisen under a significant facilities management contract and she has been instructed as a junior on a number of large construction projects with a nuclear/energy-related focus. She is familiar with the standard forms of contract used in the construction industry, including: NEC3; JCT; and FIDIC. She is experienced in using different forms of commercial dispute resolution and has represented parties in the Technology and Construction Court, arbitrations, adjudications and mediations. Some of Rachael’s significant cases include: Secretary of State for Defence v Turner Estate Solutions Ltd [2014] EWHC 244 (TCC); Lanes Group Pic v Galliford Try Infrastructure Ltd (t/a Galliford Try Rail) (2011) 141 ConLR 46, [2012] BLR 121 (CA); Lanes Group Pic v Galliford Try Infrastructure Ltd (t/a Galliford Try Rail) (2011) 137 ConLR 1 [2011] BLR 553 (TCC); Southern Insulation (Medway) Ltd v How Engineering Services Ltd & How Group Ltd [2010] EWCA Civ 999.
