Commercial litigation and arbitration.

Position

Barrister specialising in commercial litigation and arbitration. Paul appears primarily in the Commercial Court and in commercial arbitrations (and in related appeals). He has also appeared in a range of other courts and tribunals including the Mercantile Courts and Companies Court. Paul acts in a range of commercial disputes but with a particular focus on charterparty disputes, bills of lading, international trade and commodities, energy, shipbuilding, banking, aviation and insurance. He has extensive experience of interlocutory matters of all kinds including jurisdictional challenges, freezing orders and anti-suit injunctions. His recent instructions include acting for insurers in a c. US$1.6bn insurance tower arbitration; a c. US$150m heavy arbitration relating to an FPSO which lost station-keeping in a field in the North Sea; a series of arbitrations relating to a c. US$20m joint venture dispute, and a c. US$30m rig refurbishment dispute. Recent and reported cases include: “CAPE BARI” [2016] UKPC 20 (contracting out of statutory tonnage limitation); S v A & B [2016] 1 Lloyd’s Rep 604 (commodities arbitration, s. 68/69 appeal, blast furnace grade coking coal); “ASTIPALAIA” [2014] EWHC 120 (Admlty) (Damages, loss of oil major approvals); Taurus Petroleum Ltd v Oil Marketing Company of Iraq (SOMO) [2014] 1 Lloyd’s Rep 432 (jurisdictional challenge, sellers resisting enforcement of a c. US$9m judgment on grounds of State Immunity); Vitol SA v Sterling Oil Trading Ltd & others [2012] EWHC 3108 (Comm) (long-term oil supply contract, and related financing agreements; entire agreement clauses; collateral contracts); “CENK KAPTANOGLU” [2012]1 Lloyd’s Rep 501 (Charterparty dispute – Arbitration appeal – important decision on scope of the law of economic duress); “PRINCESS 7” [2011] EWHC 3940 (Marine insurance – jurisdictional dispute – conflict of laws – construction of claims settlement clause and jurisdictional provisions);appeal from “CASANNA” [2009] EWHC 1074 (Comm) (Shipbuilding; jurisdiction; State immunity);  lnvertec Ltd v de Mol Holdings BV [2009] EWHC 2471 (Ch – Arnold J) (share sale dispute – fraudulent misrepresentation); Natwest v King [2008] 2 WLR 1279 (banking/High Court jurisdiction); and “REMMAR” [2007] 2 Lloyd’s Rep 302 (ship sale and purchase – arbitration procedure – arbitration award set aside for serious irregularity under s68 Arbitration Act 1996).
