Position

Paul’s practice focuses on shipping, international trade, commodities, energy, banking, aviation and insurance, including related interlocutory matters such as jurisdictional challenges, freezing orders and anti-suit injunctions. His recent instructions include appearing for the operators of a hydrocracker unit in the Middle East in a c. US$300 million joint venture arbitration under UNCITRAL Rules, for the operators of an FPSO in a c. US$250 million rig refurbishment arbitration under LCIA Rules, and for a commodities giant in an ICC arbitration under a services agreement for exploitation of minerals in Southern Africa. His reported cases include First City Monument Bank Plc v Zumax Nigeria Ltd [2019] EWCA Civ 294 (CA) (imposition of trusts in international banking and trade finance relationships); Nautical Challenge Ltd (“ALEXANDRA I”) v Evergreen Marine Ltd (“EVER SMART”) [2019] 1 Lloyd’s Rep 130 (assessment of damages where Vessel unable to finance repairs and return to market post-collision); Heiser v Republic of Iran [2019] EWHC 2074 (QB) (State Immunity; enforcement of foreign judgments); "CAPE BARI" [2016] 2 Lloyd’s Rep 469 (contracting out of statutory tonnage limitation); S v A & B [2016] 1 Lloyd's Rep 604 (commodities arbitration; s. 68/69 challenge/appeal; blast-furnace grade coking coal); "ASTIPALAIA"[2014] EWHC 120 (Admlty) (damages; loss of oil major approvals); Taurus Petroleum v Oil Marketing Company of Iraq [2014] 1 Lloyd's Rep 432 (commercial enforcement; letters of credit; State immunity); Vitol v Sterling Oil Trading [2012] EWHC 3108 (Comm)(dispute under long-term oil supply contract; related financing agreements); ‘CENK KAPTANOGLU’ [2012] 1 Lloyd's Rep 501 (Charterparty; economic duress); "PRINCESS 7" [2011] EWHC 3940 (Comm) (Marine insurance; jurisdiction; conflict of laws); Invertec v de Mol Holdings [2009] EWHC 2471 (Share sale; fraudulent misrepresentation); appeal from "CASANNA" [2009] EWHC 1074 (Shipbuilding; jurisdiction; State Immunity); Natwest v King [2008] 2 WLR 1279 (Banking; jurisdiction); and "REMMAR" [2007] 2 Lloyd's Rep. 302 (Ship sale; misrepresentation).
