Position

Poonam Melwani was called to the Bar in 1989. She practices across the spectrum of commercial, insurance, re-insurance and shipping law, in the Commercial and Admiralty courts and before arbitral tribunals. She has particular expertise in marine insurance and reinsurance, international trade, charterparty and bill of lading disputes, as well as the myriad procedural issues that arise such as freezing injunctions, jurisdiction disputes etc.  Recent cases include the CSAV v Hin Pro Litigation [2015] 2 Lloyds Rep 1 (Court of Appeal) and [2015] 1 Lloyds Rep 301 where a new approach to damages for breach of exclusive jurisdiction clause was adopted and which involved applications to the Supreme Court here and in Hong Kong and allegations of shipping fraud contempt and jurisdiction clauses.  Other recent cases have concerned the implication of an indemnity in voyage charters, obligations to negotiate in good faith and the legal requirements of berth and port nominations. She has also acted on an enormous amount of marine insurance work and significant re-insurance work. Cases include the US$20 million reinsurance dispute of Beazley Underwriting Ltd v Al Ahleia Insurance Co [2013] Lloyds Rep I.R. 561 where Poonam successfully represented insurers and made new law.
