Position

Queen’s Counsel (2006) specialising in shipping, admiralty, insurance and general commercial work both in court and arbitration.

From 2016 to 2018 Nigel led the team in The "ATLANTIK CONFIDENCE" [2016] EWHC 2412 (and in extensive related proceedings). This was a scuttling case and the first occasion in which the shipowners' right to limit was successfully challenged (in English proceedings) under the 1976 Limitation Convention. Nigel recently appeared on behalf of the “Ever Smart” interests in the Court of Appeal collision action involving the application of the crossing rules: The “Alexandra 1” [2018 EWCA 2173, the first collision appeal for about 15 years. He is currently involved in various unsafe port cases.

In recent years he has appeared abroad in the Kuala Lumpur Arbitration Centre (commodity/letter of credit dispute) and in the Hong Kong Final Court of Appeal in Kulemesin v. HKSAR [2103] 2 Ll.R. 367 (the application of the crossing or narrow channel rules in a collision in Hong Kong harbour) and has given expert evidence abroad.

"SEA ECHO" [2012] 1 Ll.R 140: Admiralty practice, counterclaims and costs; SHIPPING: "WESTERN MOSCOW" [2012] 2 Ll.R. 163: liens on sub-freight; "GENIUS STAR" [2012] 1 Ll.R. 222: construction of Inter-Club Agreement; COMMODITIES: "MERCINI LADY" [2011] 1 Ll.R. 442: Fob Sellers' duties; JURISDICTION AND ARBITRATION: "ATHENA" [2011] EWHC 589: incorporation of arbitration clause into salvage contract; "NICOLAOS A" [2015] 1 Lloyd's Rep. 504: "seat of arbitration" and charterparty incorporation; INSURANCE: "DC MERWESTONE" [2013] 2 Ll.R 131: perils of the sea/fraudulent presentation; General commercial: Alpha Bank SA v Vardinoyiannis [2013] EWHC 4220: cross border insolvency and freezing injunctions; ICBCL v CGCF [2014] EWHC 3156 (anti-suit jurisdiction/jurisdiction clause); Brave Bulk v Spot On Shipping [2009] 2 Ll.R. 115 (anti-suit injunction).
