Position

Simon Croall QC has a broad commercial practice which encompasses shipping law, insurance and reinsurance, and mercantile disputes. He regularly appears in the Commercial Court, Arbitrations (including ICC and LCIA arbitrations), appellate courts, and recently led the team in the House of Lords in Transfield v Mercator (‘Achilleas’). Recent reported cases include: Transfield v Mercator (‘Achilleas’) [2007] Lloyd’s Rep plus 80 (CA) and [2007] 1 Lloyd’s Rep 19 (Comm Court) – landmark case on damages for late redelivery in time charters; Rafaela S [2005] 2 AC 423 (HL) and [2003] 2 Lloyd’s Rep 113 (CA) – relating to legal effect of ‘straight’ bills of lading; Front Carriers v Atlantic & Orient [2007] 2 Lloyd’s Rep 131 – repudiation of time charter; ASM Shipping v TT1bII (No 2) [2007] 2 Lloyd’s Rep 155 – power of court to debar a party from appearing in arbitrations; ASMShipping Ltd of India v TTIvII [2007] 1 Lloyd’s Rep 131 (CA) and [2006] 1 Lloyd’s Rep 375 (Comm Court) – challenge to arbitrators on basis of bias, whether bias could be waived and circumstances when court of appeal can entertain an appeal based upon alleged breaches of Human Rights Act 1998; TTMI Ltd v ASMVI Shipping Ltd of India [2006] 1LLR 401 – freezing injunctions over unpaid freight; Tryg Baltica v Boston Sefiros and others [2005] Lloyd’s Rep IR 40 – relating to the effect of pesification in Argentina upon underlying insurance and London reinsurance contracts; Markel & others v La Republica Coinpania Argentina de Seguros Gerneralis AS and others [2005] Lloyd’s Rep IR 90 – relating to the incorporation of a jurisdiction clause into a policy of reinsurance.
