Position
Practice covers a wide range of company and commercial work in court and international arbitration (including ICC, UNCITRAL and LCIA). Acted for Nomura in a dispute relating to its acquisition of part of Lehman Brothers; and acted for JP Morgan in a dispute about services provided under a ‘tripartite repo agreement’; and acted for the Commercial Bank of Syria in relation to Performance Bond and guarantees. Acted for HSBC in the test case with the OFT about overdraft charges. Previous experience includes acting: for Gallaher, the tobacco giant, in a major Commercial Court trial; for Apple Computer in its dispute with The Beatles concerning the iTunes Music Store; for Fulham Football Club in court, FIFA and CAS proceedings; for Sumitomo in a dishonest assistance and rogue trader claim, for Hutchison Whampoa in a claim concerning the financing of its 3G telecoms subsidiary; and for Carlton and Granada in their dispute with the Football League concerning the liabilities of ITV Digital. He has been instructed in financial services regulatory matters and has advised banks in a variety of contexts, including in relation to ISDA matters. In the energy and utilities sectors he has acted for oil and gas majors, electricity generators, suppliers and traders and for Rowan companies in a trial about the Gorilla V jack-up drilling rig. He has recently completed a trial about O2 Emissions allowances. Daniel also specialises in jurisdiction disputes, including anti-suit injunctions and stays.
