Position

Richard is a criminal, fraud, and regulatory practitioner. He appears as trial counsel in the Crown Court on behalf of defendants, but also has wide experience of related public, civil, and appellate proceedings. Richard’s recent fraud work has included a number of banking frauds involving attacks on the security systems of High Street banks. He has also been involved in a number of “hidden assets” confiscation cases, including an application to the ECHR (Brown v UK) and an appeal to the Court of Appeal Civil Division in R v G [2011] EWCA Civ 69. Richard’s has defended companies and individuals in prosecutions brought by DEFRA (veterinary medicines fraud), the Environment Agency (breach of European Waste Directive), the Department for Business and Regulatory Reform (perjury in winding up proceedings) and the Health and Safety Executive (deaths at work). Richard has been involved in the cases arising out of many of the significant large scale protests in recent years, including the G20, the Stop the War campaign, and the SHAC litigation. He represented one defendant in the Ratcliffe on Soar power station case that collapsed following revelations about the undercover police officer, Mark Kennedy. His appellate experience is wide and includes R v T [2011] 1 Cr.App.R. 9 (wide ranging criticisms made of evaluative technique used by FSS), R v RM and others [2010] EWCA Crim 2400, (scope of statutory defence), R v Asfaw (UNHCR intervening) [2008] 1 AC 1061 HL (incorporation of international human rights law).
