Position

Specialist in all types of commercial law (including contract law, computer and construction disputes, ADR and arbitration), telecommunications and environmental law. Extensive experience in commercial litigation and all ancillary matters, for example conflict of laws (Connelly v RTZ, [1998] AC 854 and Africa v Cape [2001] 1 WLR 1545) and international freezing orders (Banco Nacional de Commercio v Empressa de Telecommunicaciones [2007] EWCA Civ 662). Wide experience of virtually all types of contract dispute including TCC Work (see eg JDM v DEFRA (2004) 93 Con LR 133) and information technology (see eg Ardentia v BT (2008) 119 Con LR 50). Very extensive knowledge of all aspects of telecoms law, including Interconnect agreements – see eg Tonylogo v Totem and BT (2005) LTL 9/2/05; regulatory disputes – see e.g. Orange v Ofcom [2007] CAT 36, BT v Ofcom (MNO charges) [2008] CAT 12, BT v Ofcom (cost orientation) [2010] CAT 15, and BT v Ofcom (080 numbers) [2010] CAT 17; tariff charging; telecoms misuse and wayleaves. Thorough knowledge of the Competition Appeal Tribunal’s powers – see eg BT v Ofcom [2011] EWCA Civ 245. Has been involved in some of the largest environmental law disputes eg Reay v British Nuclear Fuels, R v Secretary of State for Trade and Industry v ex p Duddridge, Ngcombo v Thor Chemical Holdings.
