Position

Marika’s practice covers all areas of tax law and includes both contentious and non-contentious work. She specialises in all aspects of tax litigation (direct and indirect taxes). She also accepts instructions in the context of commercial litigation, trust and pension disputes, VTAs, and professional negligence cases where tax is involved. She has a growing litigation practice, acting for both taxpayers and HMRC (e.g. she is representing a number of BBC presenters in respect of ongoing IR35 challenges; she represented HMRC in R (Archer) v HMRC (CA); in Knibbs, Barrett v HMRC (HC)). On the advisory side, her clients include trade bodies, UK and international trustees, individuals and businesses. She advises on UK and cross-border estate planning; deeds of variation; domicile and the remittance basis; residence of individuals, partnerships and corporates, etc. She writes extensively and is regularly asked to lecture fellow professionals on various tax topics. Called in 2002. Before joining Devereux in 2014 she practised at Gray’s Inn Tax Chambers. Attorney General's C Panel.  Panel Member of the Bar Pro Bono Unit.
Publications: Co-authored McCutcheon on Inheritance Tax (5th, 6th and 7th ed.). Principal Editor of Whiteman & Sherry on Capital Gains Tax; Regular contributor to professional publications. Lectures in tax law (formerly tought tax at at King’s College London and Cambridge University).

Marika Lemos acted in HMRC v Peter Drown and Leadley, which centred around the issue of whether claims for relief could be made after death by the personal representatives in relation to assets that had become of negligible value and loans that had become irrecoverable before death.
